## Situation Overview

The individuals in distress are elderly individuals who rely on their social security income (SSI) to make ends meet. Unfortunately, their SSI payments suddenly ceased without a clear explanation. The Social Security Administration (SSA) claims that their bank account had an excess of $3,000 at the beginning of the month, which caused the interruption of payments. However, the individuals in question use the majority of their funds on the second day of the month to cover rent and bills, leaving only a fraction of the $3,000 remaining. Despite appealing the decision, the SSA maintained their stance without providing any detailed reasoning for declaring them ineligible for SSI benefits.

## Challenges Faced

The elderly individuals now find themselves in a precarious situation, unsure of how to rectify the issue and afraid to speak up for fear of losing their vital medical assistance. A. This is not Social Security, this is Supplemental Security Income.
    B. SSI has an asset limit of $3,000 for a couple. If as of the first moment of the month (before there SSI gets deposited) they have more than $3,000 they are not eligible for payment for that month. They need to provide proof they have less than $3,000 in their bank account and they can get payment reinstated next month.

They also need to read all their letters more closely. This should not be coming as a shock to them. If they have been on SSI for any length of time, they have received this information many times.

Speak with the landlord and pay the rent every two weeks so that the account remains low. Buy grocery gift cards to reduce the cash balance.

If they are 75, why are they on SSI and not standard Social Security, which has no income limit?

Is ssi their only income, or do they also receive retirement benefits from social security?

  • funfornewages

The land of the free is provided by the taxpayers – so if they are getting Supplemental Security Income (SSI), which is a welfare program and this money come from the taxpayers since SSI is not Social Security [earned] benefit.

ALL that is asked of them is to play by the eligibility rules. And if they have had this (SSI) entitlement for a long time, and have no mental impairment, then they really need to know the rules and abide by them.

Do they have no Social Security earnings upon which they could have earned a Social Security benefit?

Some banks deposit treasury funds (including SSI) early (before the first moment of the month). It is possible that SSA is counting the SSI payments as a financial resource when it should be excluded. If the early SSI payments are the only reason they’re over the $3k asset limit for a couple, then they may not be ineligible for payment. This will require them (or you) to review their bank statements.

Some states have old age pension they might look into that

  • nearmsp

A couple receives $1415 a month. If the liquid assets increase above $3000 SSA will stop payments until balance goes below $3000. They may miss one month’s payment. OP has not specified how much above $3000 the balance is. So could be withholding payment for longer time. How many months the balance was above $3000 will determine that.

They can still appeal that 2nd denial – it will be a long wait for a judge- get a ss attorney soon

  • ice4Breakfast

They should be on SSDI not SSI.

  • ChrisEMT1

One option, if the SSI gets reinstated, is on the day before deposit (usually the 1st, but on the Friday before the 1st if it falls on a weekend or holiday) take out as much as possible for the rent and put out into a money order. Then on deposit day, get the rest of the rent. Or pay a utility bill, or other bill(s). Your parents should get this saying, tell them, after they pay their bills, to make a withdrawal of everything except what is needed to keep the account open, and put it “in the matress”… and no, I don’t mean do anything illegal. Put it in a safe space so that they can have cash on hand to pay an emergency bill, or if they can save a little but up, go on a vacation.
