    I appreciate all the replies and of course professional legal advice would be my next step. I just thought I’d throw the question out there to this community to perhaps first get some basic input.

    As stated above, the house is legally in my name as originally drawn up by a lawyer with the inclusion of the 33.3% to her of any profit on the original purchase price if I should sell the house.

    I suppose the question is/should have been, does she have any more legal say than me over the future of the house given that she is currently residing there and is a Canadian citizen?

    In New Brunswick, common-law couples do not obtain rights to family property on separation. So your rights are defined by the laws of ownership and your agreement.

    The Property Act says that you have the same property rights as a Canadian citizen.

    It seems likely that she has no entitlement to possession of the duplex, unless NB landlord/tenant law applies to create a tenancy. You need a legal opinion on that one.

    It’s also likely that the agreement that you made is not binding on you, unless she gave something up or you got some benefit for it. This requirement is called “consideration” in law. If it is not present, then the agreement is void, subject to certain narrow exceptions. You should ask the lawyer that you meet with about the possibility of promissory estoppel applying here. That doctrine could create a right of possession for her, depending on your dealings.

    I am not a NB lawyer, so this is surface-level stuff you are getting from me. There may be other NB laws that apply that I don’t know about. So you definitely need to consult with a NB lawyer.

    EDIT: You wrote that you bought the duplex “solely”, but I can’t tell from your later post if she is on title to the house or not. If she is actually a registered owner with a 33% interest, the situation is completely different.
