Mate. For the agreement to be binding, she has to get a certificate from a solicitor to say that they have explained it to her. Any solicitor with any competence at all will point out that if she is in receipt of Centrelink Benefits, Centrelink will veto the agreement.

Sometimes there are consequences that you just cant duck.

On an aside, if you donÔÇÖt want to be a father, you should get a vasectomy. ItÔÇÖs not good enough to just say it. Contraception fails, and if you get someone pregnant itÔÇÖs out of your hands.

You need a lawyer. For her to receive the maximum rate of family tax, she will need to go thru child support and declare there is a private arrangement (no documentation will need to be supplied as proof).

The way centrelink words it, it makes it sound like there needs to be child support arrangement through child support. But if you declare there is a private arrangement, then she will still receive the maximum rate, and they won’t come for collections. At any time, she could ask child support to start collections, and they will start from that date.

The only other option is to not be on the birth certificate.

This is why you need a lawyer. To make sure you have something drawn up that is both airtight and legal.

Yes she can and get back paid, just go an setup child support yourself so you don’t have to worry about some big bill in 10 years.

  • potatoarmy13

Yeah this isn’t going to work. She might be ok now with her well paying job, but what if her circumstances change? Saying you have no intention of being a dad doesn’t absolve you from the consequences of your actions. It takes two to tango.

You might not want to be a father figure, but you have just opened yourself up to being a financial figure.

ETA family lawyer right away for proper advice about relinquishing parental responsibilities etc

  • ukacunt

See if she will refuse to name the father or even hint who it is.

That’s about your only get out of jail in Australia and she has to be adamant about it as all sorts of busy body agencies will make threats about not getting family allowance etc.
