    ItÔÇÖs not really a stamp. It is a sentence in size 6 font on the top of page one . honestly, I fold it over with a paper clip when traveling and unfold it when I go through border patrol back in the US no one has ever unfolded my page to even see it.

    If you have a passport without the stamp (assuming you were never asked about your sex offender status on the application), then it is not a crime to attempt to use it for travel. Whether or not you are successful will depend largely on what jurisdiction you reside in.

    Federal IML says that you have to provide 21-days notice of travel to your registering agency. That registering agency is then required to forward the information to Homeland Security and/or U.S. Customs. It is the sending of this information that will trigger Customs and the State Department to check if your passport was issued with the requisite notice, and if not, they will cancel your passport and require that you get a new one.

    Essentially, the State Department doesn’t want to take the resources to preemptively gather the needed information on a passport application, then cross-reference it and make a determination if the person requires the special mark/notice. IML was largely an unfunded mandate. Since a lot of people request a passport but never actually use it, the State Department instead does the check only when notice is given to them about intended international travel.

    However, a passport can be canceled extremely quickly, and its status transmitted to all U.S. (and many foreign) ports. Hence the risk that if you attempt to use an unmarked passport there is a strong chance that you will end up detained at the air/land/sea port and told your passport is invalid.

    But if you live in a jurisdiction that doesn’t send your travel notice to the feds, then there is a better chance that your unmarked passport will remain valid. Not all state’s require notice of international travel. Federal law says that you have to give such notice even if the state doesn’t require it, but if a state doesn’t require it then there’s a good chance that they won’t have the links in place to transmit the travel information to the feds. There’s also states where you might not have to give the notice at all die to their court’s declaring portions of the state SO laws unconstitutional on various grounds.

Australia has law that essentially bans international travel – SO on register have to seek permission to travel and outline itinerary to even get a look in. Many have to seek legal advice to do application to have any chance of getting approved. Only country in the world with law like this, and just seems honestly excessively punitive.
