Title: Dealing with a Vexatious Claim in Small Claims Court: How AI Legalese Decoder can Assist

Introduction:
Greetings, fellow readers!

I am currently facing a rather vexatious claim in the Small Claims Court. In a nutshell, the Claimant posted a video on Facebook, expressing his views about the local area. I shared the video on my Facebook page, along with a caption that legitimately criticized his viewpoints. Unexpectedly, the Claimant launched a claim against me via MCOL, seeking approximately £8,000 in damages for copyright infringement. The case has been transferred to a South East county court, causing significant delays in reaching trial. Meanwhile, the Claimant incessantly sends me correspondence demanding payment of damages.

Exploring Legal Options:
Initially, I contemplated using the permitted act of fair dealing as a defense, since I reviewed and criticized the video within my Facebook group. Alternatively, I considered arguing that by sharing the video, I provided a hyperlink to the original source and gave proper authorship credit, without exposing it to a “new public.” However, the distressing aspect of this situation is the year-long wait for the trial. Although I would prefer to seek a strike out, I lack sufficient knowledge in this area of law, and the solicitors’ fee quotes I received far exceed the potential losses I might incur if the trial is unsuccessful. Recovery of any money spent seems unlikely.

AI Legalese Decoder: Simplifying Legal Language for Everyone

Introduction:
Legal documents are infamous for their complexity and intricate terminologies, often referred to as “legalese.” These convoluted phrases and expressions, intentionally designed to be exclusive to legal professionals, pose significant barriers to the general public’s understanding and engagement with the law. However, with the advent of Artificial Intelligence (AI) technology, a solution to this long-standing problem has emerged: the AI Legalese Decoder. Understanding the Challenge: The Complexity of Legal Language
Legal language is purposefully complex, as it aims to provide absolute clarity and eliminate any ambiguity or misinterpretation of laws and contracts. Nonetheless, this complexity limits access to justice, marginalizes individuals with limited legal knowledge, and hampers their ability to comprehend their legal rights, obligations, and responsibilities. It is extremely intimidating to face a pile of legal documents filled with obscure terms, archaic expressions, and lengthy sentences. This intimidation factor often dissuades people from attempting to understand the legal implications of their actions or seek legal assistance when needed.

Enter the AI Legalese Decoder:
The AI Legalese Decoder has emerged as a groundbreaking solution that harnesses the power of artificial intelligence to translate complex legal language into easily understandable, plain English. The result is a more accessible and comprehensible document that can be easily understood by people without any legal background.

How the AI Legalese Decoder Works:

When you say you shared the video, I assume you just mean by hitting the “share” button on Facebook, and not making a copy of the video? And which he could have literally prevented within two seconds by changing the privacy settings on the video anyway?

If so, I don’t think you will even need to bother making a complicated fair use defence. When a user uploads content to Facebook they grant FB a license to use the content and distribute it around the platform in line with the platform’s functionality. In effect, by uploading the video publicly in the first place, they consented to exactly what’s happened – i.e. FB allowing people to share it using the platform’s functionality – so as far as I can see there is no breach of copyright to defend at all.

Additionally, if he launched the claim “without warning” (i.e. without a letter before action giving you 14 days to respond) then that’s a procedural breach anyway and you’d simply tell the court this and it ought to be a slam dunk.

So the easiest/cheapest thing to do is just call his bluff:

    >Dear X,
    >
    >I have read your continued correspondence with great interest and curiousity, along with the papers recently served to me by Y County Court.
    >
    >
    >It is very difficult to understand the nature or basis of your claim, given the lack of any conceivable breach of copyright nor any monetary damages I can possibly imagine having been incurred.
    >
    >As such, there is nothing I can see for us to negotiate out of court and I will not be entering into any further correspondence regarding your meritless claim, which you are nevertheless free to progress if you wish.
    >
    >Any further spurious demands for payment will be reported to the police as harrassment.
    >
    >Warmest regards,
    >OP

And then just submit your defence to court outlining the above and noting you didn’t receive a letter before action.

When you say you shared it on Facebook, do you mean using the in built Facebook share feature? Or did you download it and reupload it?

  • AR-Legal

Not my specialism, but I always thought that intellectual property issues such as copyright were dealt with by a specialist court, not the County Court.

How does he justify the £8,000 damages?

How is the video monetised on Facebook?

    NAL.

Others here have given you reasons why sharing the video via facebook isn’t copyright infringement.

Its open to you to write to the claimant pointing out all of this, that their claim is entirely without merit, and that if they don’t withdraw their claim you will be seeking that they pay your costs on an indemnity basis when you inevitably have it struck out/win at trial.
