Seeking Advice on Medical Situation with Dentist: AI Legalese Decoder to Help

I am seeking guidance in a recent incident I went through at a dentist’s office, and I would appreciate any advice you can provide. I am a male in my mid 20s and I visited the dentist to have a filling done on my back molar. During the procedure, the dentist administered lidocaine and performed an injection into my gums on the upper right side. However, my memory abruptly cuts off after that. The next thing I remember is waking up on a gurney, being transported by ambulance to the hospital. The EMTs immediately noticed some concerning symptoms, including the effects of Horner’s Syndrome such as drooping of the right side of my face/eyelid and unequal pupil size. I also experienced difficulty speaking and swallowing, as my throat was completely numb.

Upon arrival at the hospital, I underwent a series of tests including blood work, an MRI, a CAT scan, an EEG, a chest X-ray, an echocardiogram, and more. Blood thinners and medication for stroke were administered to me as well. The doctors primarily expressed concern about the abnormal appearance of my Carotid artery as shown in the CAT scan results. They described it as a possible Carotid Artery dissection, wherein the layers of the artery separate, compromising blood flow to the brain and potentially causing severe health complications.

After being closely monitored for a few days, I underwent another CAT scan which fortunately revealed that the artery had returned to its normal condition. It is believed that the injection used epinephrine, a blood vessel constrictor, which inadvertently entered my artery and triggered spasms. Due to this arterial spasm, blood flow to the brain was impeded, resulting in a seizure. Following three days of observation, I received a clean bill of health and was discharged from the hospital.

I am immensely grateful that I avoided any long-term damage or complications, despite the evident lack of blood flow to my brain during the episode. However, I am now faced with a significant amount of medical bills resulting from this incident. Moreover, I won’t be able to work for the next six months due to state regulations requiring a driving ban following a seizure. Additionally, I must avoid activities such as climbing ladders or operating automated equipment, which unfortunately are integral parts of my job.

As someone who has never pursued legal action before, I am uncertain about the appropriate steps to take in this situation, or whether it would even be reasonable to consider a lawsuit. Should I proceed with suing to cover my medical bills? I would greatly appreciate any assistance or advice you could offer. Thank you sincerely for your help!

I am not sure what your case would be here. Your dentist followed all the protocols and you were immediately treated. You had an adverse and not very commom reaction, which was unforseen.

Who are you thinking of suing? It sounds like your dentist noticed the emergency immediately and called paramedics. From what you wrote, emergency responders acted quickly and saved your life, and you receiver appropriate care in the hospital.

  • breetome

It sounds like you had a preexisting condition that neither you or your dentist were aware of. Your dentist immediately called the paramedics to assist you. How exactly is your dentist in any way liable for your condition?

Sounds like they used the common numbing method and when you crashed they acted appropriately to save your life. How would your dentist possibly know you had this problem, he wouldnÔÇÖt unless you informed him. He couldnÔÇÖt of taken any steps to avoid this happening unless he knew about your issue ahead of time.

Sounds like an extremely rare problem you have.

I don’t think you’re going to get anywhere with this.

  • Arudin88

You’d need to sit down with a medical malpractice attorney specializing further in dentistry

Just be aware that not every bad outcome inherently rises to the level of malpractice. A mixture of lidocaine/epinephrine is very commonly used for local anesthesia

  • franklopuhb

I’m confused about where you feel the malpractice was? What do you think your dentist did that wasn’t standard procedure/indicated

  • chantillylace9

What do you think the dentist did that was negligent? Was there any breach of the duty of care? From what you wrote, I do not see anything that leads me to believe the dentist did anything wrong. You got a single injection of Novocain and had some sort of reaction, and the dentist immediately got you help.

It is unfortunate, but does not sound like a malpractice case as there is nothing the dentist could have done to prevent what happened. You had some preexisting condition that caused this to happen, the dentist did nothing wrong.

  • Emergency-Train-5177

(Not a lawyer) It DoesnÔÇÖt sound like the dentist did anything wrong, IÔÇÖm sorry this happened to you! Maybe you can apply for some kind of government assistance, and some hospitals have programs for people who canÔÇÖt pay. IÔÇÖm glad youÔÇÖre ok!

  • danbrew_at_the_beach

Give the facts as youÔÇÖve recounted there here IÔÇÖm guessing it would be difficult to prove negligence. You canÔÇÖt just have a story with damages (bills), you need to show causation. What the dentist did or did not do that caused your reaction? As others have said, dude likely saved your life.

If your state has it’s own disability fund, you probably should apply for it.

(I’ve lived in California, which has such a fund, for the last 45 years. I was really shocked to find out that there places that don’t have a disability fund. California makes it very easy to get disability and you can get it for 6months.

But in states without such a fund, all you can do is apply for SSDI, which is very hard to get and right now it takes 2-3 years to get through the whole process and all the appeals.)
