## Situation Overview

I let a friend (20 years old) borrow my car, and he got into a car accident after having one drink with dinner. Another vehicle pulled out in front of him in a roundabout, and he swerved to avoid colliding with the other driver, losing control of my car in the process. The other driver then fled the scene. The cops arrived at the accident and performed a breathalyzer test on my friend, revealing a blood alcohol content of .02%/.2g/l. Since he is not 21, he was charged with drunk driving.

## Insurance Coverage Issue

Both my insurance and my friend’s insurance do not cover the damages caused, as my insurance does not cover my car when someone else is driving it, and his insurance does not cover him while driving another car.

My insurance does not cover my car if somebody else is driving, and his insurance does not cover him while driving another car.

with this statement, why are you asking the question? you both did something other then agreed to.

Not an expert here and my explanation is based on my knowledge of Dutch insurance.

I think you should not check with his car insurance because that is for his own car. But You should check his liability insurance. If you hold him liable his liability insurance should help.
But since it is used to commit a “crime” his liability insurance might reject his claim but that doesnt change the fact that he is liable for the cost.

    Congratulations, you’ve just bamboozled yourself

  • No-swimming-pool

No. Both your car insurances don’t cover and any other insurance can point to “drunk driving” and not pay.

How can it be legal to drive a car whitout insurance? And also kinda stupid but driving and drinking is kinda stupid also but the age to drink is 18 in Italy and the limit of DUI is 0.05

So the whole DUI thing is irrelevant and your screwd

    This varies massively by country…

Its your car so it is your responsibility. If i where your friend i wouldnt have paid for it. I would assume you would have a proper insurance if you let me drive it

  • YougoReddits

Even if you manage to get some kind of insurance to handle this, think hard if that is what you want. if a no-claim kind of deal is involved, this will set you back for YEARS. the fee might go up a multitude of the actual damage cost.

source: i unsuccessfully cut in front of another car once (successfully shoved the rear end of my car into the other’s front wing…)

Combined damages was around €700, but letting insurance handle it would set back my no claim three years and raise my insurance fee for almost €2000 spread over the next two years. Insurance was like ‘you sure you wanna do this?’

So I ended up coughing up the money myself despite being insured

  • Radiant-Ad9999

    Nope.
Drinking is mutually exclusive with being insured.
Your only option is to open a savings account and start again.

  • Confident_Access6498

Insurance does not cover this. You have to rely on his good will to repay you since you should have checked his state before giving him your car. The case is closed.

  • DistinctAirline5654

Italian insurances always cover if someone else is driving.

  • Excellent_Coconut_81

Drunk driving AFAIK would void any insurance, and any insurance other than car insurance doesn’t apply to damage done while driving.

  • RealWalkingbeard

A few people have offered their car to me and on the one occasion I accepted – my dad’s car – I held everyone up to pay the €35 for a single day’s insurance for me to drive that car. It is not worth the risk completely alcohol-free, and it is not worth it with a drink either.

I’m sorry, because I have been in a major crash – I was not the driver, but should never have got in the car – but I think you have to mark this one up as experience, and at the very least pay half the costs yourself. You were a fool to allow it.

Bad luck, and better luck in future!

  • SafemoonHodler91

Fuck legal, if the other person fled te scene. You just had to say you where driving yourself. There is only car damage. So there is no way the insurance company is going to police files for this accident. So you would have had the money.

And your friend was not drunk driving, I mean by law.. but come on, one drink. Just a bullshit law. If he was 21 not wrong keep on going..

The other person fled the scene because he had something going on as-well. Many rules where bent here skippy. You had to bent to it.

So no, not legally. To late for that.
”My insurance does not cover my car if somebody else is driving, and his insurance does not cover him while driving another car.” Just had to say no I guess. With rules like this.

WTF this is just made to not pay a fucking penny ever. Why even gat a license if almost anything is not paid out. Like don’t you have a insurance that insures you and the rest of the people that you are insured… Not letting people drive in other peoples care damn.
