Facing unexpected challenges during a divorce can be overwhelming. Recently, my ex served me with divorce papers, and while I anticipated this, I was taken aback when he demanded spousal support and requested that I cover his lawyer fees. As a sole earner making just $4,000 a month compared to his income of $10,000+, it is impossible for me to afford legal representation. In this stressful situation, I am left wondering how to proceed. Adding to the complexity, my ex’s career as a musician makes it difficult to establish his actual income, although I do have access to his bank statements for reference. You need to start interviewing lawyers. They will work out a payment plan or they will go to court to try to have the 3x person pay some or all of your fees. You don’t have to buy a car tomorrow, but start going on test drives with lawyers. You are risking getting railroaded here if you don’t start at least talking to lawyers, and if you get a lawyer you may end up coming out of this much better. This is an investment in the rest of your life, start calling tomorrow.

  • ExampleSad1816

A good lawyer will take payments and heÔÇÖll get this entitled person put in his place. Seriously donÔÇÖt worry about the expense, your ex will probably pay in the end.

  • Consistent-Ad3191

I would think that you would get the spousal support due to his income he can request it, but I don’t think they would give it to him

  • TinyTinasRabidOtter

NAL he can ask for whatever he wants, that doesn’t mean a judge will agree he can get it. They will look at both of your finances, work history, etc and make the call from there. If he makes 3x your income then more than likely he’d be the one paying spousal support, and a few judges with a petty side might just make him pay that, just as an “are you kidding me, you don’t even qualify and you wasted my time ruling on it. Pay her instead”

  • rubbersoul2022

If he is beginning the process like this, let me emphasize the need for you to get a GOOD lawyer. Specifically, you need to ask about their experience with high conflict divorces. You might want to start with his ability to hide his income and ask them how they will figure out his actual income.

  • Genericrpghero11

He can ask for anything he wants. The only thing that matters is the actual numbers. If you are still on the account you need to go get print outs of every single check deposited and everything possible from the bank while you are able to.

As others have mentioned there is a good chance in California you can use joint money to settle the lawyer fees. A majority of whatÔÇÖs happening is lawyer talk and scare tactics. It will get sorted out.

  • chantillylace9

Get consultations from at least three different lawyers, make the appointments right now and try to find the best reviewed ones. You can call the California bar for recommendations.

Like other people have mentioned, he will be responsible for paying the attorney, so just talked to the attorneys and they will help you.

  • noooddoood

He can ask for whatever he wants. You need a lawyer so you can put your own requests in your response. Ultimately most likely you will each have to pay your own attorney fees, in most states, and if you can prove his income based on tax documents, pay stubs, bank statements then you will be able to do so. If he is lying about how much money he makes, the court will not look kindly upon him. He can be held in contempt, those are forms that are filled out under penalty of perjury, and if the court finds he is trying to hide or move assets to show he makes less than he does, a forensic accountant may need to be brought in, at his expense, and depending on the state again, up to the entire difference between what he does claim is his income and his actual income could be awarded to you on top of any child/spousal support they otherwise determine you to be eligible for. So keep copies of all documents and get official copies of the bank statements NOW.

A contested divorce means you need a lawyer. If you have kids, you really should get a lawyer. There are often free and low-income family law services available, check your state bar website for resources and contact any local law school or university with a law dept.

  • icecube404

Look for a legal aid in your area. If you qualify they can represent you for free

  • JDSHISLER

In CA, most cities have a law library where there are paralegals that can help you. Free. The other option is to speak with the free self-help at the courthouse.

Your time frame to get your answer on file starts from the date you were served. You need to make sure you get it in with the court prior that date. If not, he will get a default, you wont be able to respond. Short version, he wins.

Start by going to the courts website for whatever county your case is in. Go to the family law portion and divorce. They all have instructions on how file a response and all the forms there are free.

You will need to try and get a fee waiver. Filing your answer will cost $435 if you do not have a fee waiver. Forms are there for that as well.

This gets you started. Next, ignore all “advice” you get from anyone that is not a legal professional in California. Nearly everything I read is wrong in CA. You will need an attorney if he has one.

Best advise, file your answer, find a way to be amicable and separate as quickly as possible. Attorneys get rich on people fighting over money, custody, and most of all, their hugely inflated egos. Who cares if the other gets the (insert excuse). Every line item you fight over will cost another $10k at minimum.

With the assests you two have, yall could have filed for free and moved on.

PS, as a musician, while he might make more, he has writeoffs. You are a w-2 with set income. On paper, he probably makes less. Good luck with everything!
