    It *is* however illegal, under the National Labor Relations Act, for an employer to threaten a worker for discussing their working conditions. Discussing your working conditions is a prerequisite to labor organization (e.g. forming a union) and thus is a protected activity.

    To me this sounds like harassment and bullying by her former workplace especially if she has documented the behaviours that affected her mental health prior to them firing her..

    Assuming she didn’t sign anything to prevent her from speaking about the employer after termination, she was now an ex employee and as long as she didn’t lie (and it sounds like she didn’t even identify them), they have a mighty tall hill to climb to prove anything.

    even if she signed an NDA they are very unlikely to go after her for it or win if they do. they’re being bullies. if she still worked there they could fire her. but they’ve already done that. if an actual legal filing from a lawyer comes her way, she should have a conversation with an employment lawyer. the chances of that are low.

    This is purely speculative (and not legal advice) because I’m not them and didn’t write the letter. What your friend likely received is what is called a cease and desist letter. In short, they’re usually the first step you take against someone when you think they’ve wronged you in a way that they could sue you for. Lawsuits are expensive, so rather than jump right to suing, the first step is usually sending a letter to say “stop doing this or we’ll escalate to a lawsuit.” Sometimes that works, most of the time it doesn’t because a cease and desist letter has no teeth. They’re saying “please stop” and often the response is simply “no.”
