    I just had to recheck something in the act. Under Age of Legal Capacity (Scotland) Act 1991, someone under 16 cannot enter into a transaction except when 1. of a kind commonly entered into by persons of his age and circumstances, and 2. on terms which are not unreasonable.

    I believe both terms are broken here, as most 15 year olds don’t have horse shares, and paying for a horse that you cannot even see would probably be considered unreasonable. If she was still given the ability to care for the horse then it might be a different story.

    Also, generally speaking, a contract with a minor is voidable with no further payments. I know this is the case in England and Wales.

    Lastly, someone under 16 in Scotland cannot be responsible for debts except for items required day to day, so she can’t be made to pay.
