# Seeking Help with Noise Issue Caused by Corner Shop

I originally posted this in r/legaladvice and was kindly redirected here. Hello friends!

## Uncertainty Regarding Landlord Responsibility

I am unsure if this falls under the landlord flag so I have left this open for now.

A little backstory so everyone understands why I’m going insane at the moment: Summer last year I moved into the center of a bigger city in Germany. I hope this doesn’t fall under personal info but maybe the laws here have different rulings for my problem. My apartment was right on top of a little tea store and I never had any issues with them.

The tea store moved out and in moved my biggest enemy: a corner shop. Though it’s not just a corner shop, it’s a corner shop with the great concept of being the best corner shop in town. They have added pink bright neon lights and outdoor mirrors to the entire passage, plastered graffiti’s of famous cartoons and cool slogans everywhere and while I don’t care for the decor (though you need blinds to sleep now it’s basically like pink daylight in here) the noise is what gets to me. The corner shop is quite small and doesn’t even have a space to sit, so they are using the passage way as an outdoor area for customers – the customers just stand in the passage way. Now you probably think “Corner Shops don’t make noise.” And usually I think you might even be right. Except my neighbours are trying to go viral so they host parties with loud live DJ music and free drinks so they can film tiktoks about how filled the store is and how everyone should be a customer there.

I applaud their marketing strategies but the live DJ music and the loud drunken people every weekend are an absolute nightmare. I had to sleep with closed windows in the summer heat and could still hear every single customer out there. I am nowadays wearing ear plugs and a headset playing brown noise to bed every night but I don’t want this to be the solution for the rest of my life.

Many other residents here have been complaining and we already sent a signed letter with several signatures from several apartments to the owner of the passage (our landlord is a big company that owns several buildings) and the police also got called over 20-30 times by multiple tenants when it got unbearable with the drunk people outside.

Nothing happened so far, they don’t seem to slow down and they don’t seem very phased about the whole thing. Is my only solution to move out? I really love the apartment and besides the constant noise, I don’t have any issues here. Typing this while listening to the screaming drunkens outside again. Help!

    I suggest asking in r/AskAGerman

    I would keep calling the police.

    I would suggest asking a rent reduction (you and all the other tenants, so you hit hard the company), because of the noise. You can join the Mieterverein (double check my spelling) or ask a lawyer. Document ALL the times you called the police and call them EVERY SINGLE TIME they have a party.

    If the noise it’s during quiet hours (Ruhezeiten/Ruhzeit), which is normally 22:00-07:00, the police should do something and shut it down everytime you call them.
