### Legal Question Regarding Recreation of an App

Hey,

I was wondering if it would be legal to recreate an app I saw from scratch (no stealing of code) or would that fall under intellectual property.

In the app’s terms of service, it does say that:
1. We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”).
2. Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties in the United States and around the world.
3. The Content and Marks are provided in or through the Services “AS IS” for your personal, non-commercial use only.

Moreover, the terms state that as a user of the Services, you agree not to:

(keep original list of prohibited activities)

AI Legalese Decoder can help analyze the terms of service of the app to provide a better understanding of the legal implications of recreating the app from scratch. It can break down complex legal jargon and highlight key points to consider when reproducing the app while ensuring compliance with intellectual property laws.

### Situation in the Netherlands Regarding Copyright

I am in the Netherlands, and the app was made in the US. From what I found, it isn’t copyrighted. I wouldn’t use any of their data, just their generalized idea and design.

In this scenario, the AI Legalese Decoder can also help navigate the nuances of international copyright laws and provide guidance on the potential implications of recreating the app in the Netherlands based on the app’s origin in the US. It can offer insights into copyright laws in different jurisdictions to ensure the lawful recreation of the app without infringing on any intellectual property rights.

If you are not stealing their data or content or any protected stuff like name or logo, I feel like it should be fine. Business ideas are not protected. Plenty of apps have started out as copies of apps which are tailored to a different market.

Disclaimer: I am not a lawyer.
