The problem is that CS rules and standards are trying to find a single solution to a problem that looks different for every single family. My primary gripe with CS is the fact that the state takes a cut from parents who are receiving state services. Married parents whose kids receive services do not have to repay; taking money from unmarried parents to reimburse services is a tax on single parents.

I think in most normal, healthy professional relationships, you want or need “buy in” for something to work. Fathers get no choice in the matter. There’s no “buy in” ÔÇö it’s either you pay up, or eventually lose your rights and your reputation. It’s also calculated based on your income, not the child’s actual needs, so it feels cruel in that sense as well. No matter how well you’re doing ÔÇö whether you make $30,000 per year, or $300,000 per year ÔÇö you will be paying 25% to 30% of your take-home pay in child support.
It’s a system that’s adversarial and combative by design. The women/mothers/custodial parents feel entitled to the money and start looking at it as “their” money, when fathers look at it as their hard-earned money that they literally have to work for. And again, when it’s 30% of a father’s take-home pay, it’s enough to impact their own wellbeing and their ability to save up for retirement and get out of debt. I’m not sure how making a father struggle to pay their own bills and preventing fathers from saving up for their own future helps the child. My feeling is that it’s just very archaic and backwards and focused more on enforcement than involvement. Fathers provide more value than a meal ticket.

Most states use the “income shares” approach, which says a child is entitled to the same portion of combined parental income regardless of marital status. Each parent’s share is income prorated. This is one’s “guideline” amount. The custodial parent is assumed to pay their portion, and the noncustodial parent owes their guideline amount as the transfer payment we all know as child support.
So far, so good, but the biggest flaw in the child support system is the starting assumption ALL expenses are incurred in one household. Perfectly valid if the NCP never sees the kid, but not once the NCP exercises parenting time, there’s a disconnect between economic reality and policy decisions by the states.
Most states have arbitrary thresholds of parenting time. Below that number of overnights, it’s a *legal presumption* the NCP owes the full amount of child support despite their direct child-related food and housing expenses.
In effect, “paying twice”–the NCP has a duty of support to the custodial parent when the children are with her, but she has no reciprocal duty of support to him.
Let that sink in. The state is saying your contribution to your kids is NOTHING. It’s the same as an absent, derelict parent.
So it becomes a game of “dollars for days”–the NCP has the incentive to gain enough overnights to go over that threshold, and the custodial parent has an equally compelling reason to keep him under that. The hidden force compelling the discord is a bad state policy.
Then there are the completely backwards states like Washington, Texas, New York and Georgia, to name a few, that have NO presumptive timeshare adjustment at all. It’s completely up to a court’s discretion if the parents can’t agree on an amount, so God only knows what the judge/magistrate will decide. You could have 40% or even 50% of the overnights, comparable expenses to the other parent and STILL owe the FULL guideline amount. Zero predictability, capriciousness and arbitrary results among similar cases.
The state that comes closest to a fair adjustment of support is Oregon, with Michigan as a close second. In these states, the payment gradually changes as parenting time shifts. There is no “cliff effect” whereby crossing a threshold results in a MASSIVE change in support. The presumptive amounts are predictable regardless of what parenting time schedule is considered.
