AI Legalese Decoder Can Help You Navigate Family Law and Child Support Issues

Introduction
Hello, I’m eighteen, I turned that age in March of 2023. My mother and father divorced in January of 2022, and my mother made me move out with her to live with her and her boyfriend. At the time, for all of the time I was 17 until June of 2023, my dad was paying $600 to my mom per month in child support in a house that was $1500 a month. During this time, my brother (23) was living there for $800 a month to my mom. My question is, none of the CS was used on me. I paid for my own school supplies, food, I was working 30-40 hours a week DURING school season (I can prove, I have paystubs) so I could buy food, rides to work, and etc. I paid for my own color guard season, which was $1,000+ , and to top this all off, I was also living in my moms garage, with proof and evidence. There was multiple witnesses, many people who wanted to call CPS, but the situation was so messy. So, my curiosity is, do you guys think there’s anyway I can try to get any of that money back so I can at least get a head start on properly being an adult? I was kicked out the second I turned 18, and my mom was expecting that child support money and my dad sent it to me instead since I wasn’t under her roof. Is there anything I could do?

Unfortunately no, I hope your father canceled his child support payments with the court because if he didn’t then it’s her money til he does and she won’t have to pay him or you back, you would of had to take her to court once you switched households and your father then being custodial parent wouldn’t be paying and possibly could have been owed money by her then. If you’re out on your own now under neither roof you’re emancipated and no parent has to pay CS

No. The money isn’t owed to you, it’s owed to your mom. It’s real crappy what she did to you, and it’s not right. But there is no legal recourse for you to get anything from her

No. Sorry it sounds like both of your parents suck.

I don’t know how FL law compares to NYS where I am, but typically both parents “pay” cs, with the ncp paying 50% to the cp, or some other percentage usually based on income difference. So your mother should have been providing your food, clothing and shelter and anything else you needed as you were growing up, thus providing her half of your support. Also, you might look into whether you have a case due to forced emancipation. I don’t know much about that but it crossed my mind that she didn’t give you a choice, and that could be grounds for legal action of some kind. In NYS, emancipation isn’t automatic until age 21, unless some agreement is in place for college, etc.
