## Concerns with Landlord and Potential Legal Issue

Hello,

Our landlord has recently taken steps to bring a cat pet application matter to VCAT. The reasoning behind this decision stems from a prior negative experience with a different tenant and their cat, leading the landlord to express concerns over potential damages and financial repercussions. Despite the lack of grounds for their objections, it seems likely that we would prevail in our favor at VCAT.

The landlord’s behavior has been consistently challenging, particularly in addressing necessary repairs within the property. This has posed significant difficulties for us, especially considering my previous rental experiences which have not been fraught with such obstacles.

## Concerns about Future Tenancy

Looking ahead, I am apprehensive about the possibility of receiving a notice to vacate once our current 12-month lease expires. This presents a potential dilemma, as relocating in December could prove to be particularly challenging, especially with a cat in tow. While I am open to finding a new living arrangement, the timing of a potential move in December, combined with the presence of a cat, may complicate matters significantly.

With these concerns in mind, have any individuals faced a notice to vacate following a successful outcome at VCAT? If so, were they able to challenge this decision or did they ultimately comply with the landlord’s request?

The landlord doesn’t have to offer you a lease at the conclusion of your current. Respectfully, you’re likely painting a target on your back.

You’ll be moving in dec regardless now…. So I guess you’ve got to weigh up if your budget and applications are good enough to land a pet friendly property then.

Either way, you’re going to have to move December or sooner if the tribunal finds against you. Speak with the tenants union about how pet breaches are treated by VCAT – will VCAT direct you to remove the cat?

You seem to be confused about what tenant and rental providers can/cannot do. Rental provider would be well within their right to issue notice to vacate within legal notice period prior to lease ending. It would not be considered retaliatory in any form.

    Don’t tell landlords about pets.
