    You can do whatever you want and see what happens.

    It’s not a real offer without a sale and purchase agreement, and their response is not a real counter offer without signed S&P agreement.

    Firstly don’t say that you would like to start the negotiations at $xx as it immediately indicates that you are willing to negotiate. Have a basis for the offer and say it’s a fair and considered offer. Stick to your guns.

    For us, as we negotiated, the number was crossed out and the new figure added to the S and P and they sent it in an email for an e signature to intial the change. So an actual offer but not personally a hassle to organise

    Offers based on price mean very little without the terms and conditions written down; like I would accept a lower price from a buyer who was cash with no conditions vs one subject to selling another property or long settlement date.

    So if you see a place you like, get the S&P and put in a cheeky offer.

    You don’t really need your lawyer to prepare a new S&P as it is a standard form that the RE will supply. If you are are new and/or have special conditions, then get a lawyer to assist maybe on your first one so you know what to do, and you can always have a ‘subject to review by lawyer X within 5 working days’ or whatever conditions you want.

    Contact the agent and let them know you want to make an offer, they will send you a sale and purchase agreement for you to fill out with a formal conditional offer.

    Saying you want to haggle sounds like you think it is like bargaining at a roadside stall in some developing country. Don’t muck about with low ball prices and stuff too much with a property in NZ, or the vendor might get annoyed and refuse to deal with you.
