### Exploring Housing Options for Military Families

Greetings everyone, I wanted to reach out for some advice regarding my current situation. My wife will be departing for Air Force Basic Military Training (BMT) in the near future. We are aware of where her technical school is located, and it seems that her time there will be brief enough to necessitate staying in dormitory accommodations. However, I am considering temporarily relocating to be closer to her during this period, so we can spend as much time together as possible whenever feasible.

#### Difficulty of Lease Termination for Military Personnel

One question that has been weighing on my mind is the matter of our current housing situation. I am aware that individuals who enlist in the military have provisions for legally exiting lease agreements. Yet, what happens if one of the parties is already in active service? Specifically, could we potentially have both of our names listed on a lease agreement and have the flexibility to terminate it when the time comes for us to move to her first permanent base? Alternatively, is it permissible for us to enter into a longer lease term for the sake of securing more affordable rent, only to terminate the agreement after a few months?

You can probably get out of lease where she’s at tech school, but if you are currently under another lease you probably cannot break that one to go to her tech school because it might not be long enough (90+ days)

How long is the tech school?

Please go talk to the base legal office. SCRA and LL tenant stuff is bread and butter issues that they can help with, and it is free. If there is no base legal office near you that can help you, find the closest one and give them a call.

This kind of stuff could be a very expensive mistake if you get it wrong, so don’t take advice from barracks lawyers or people on the internet (I’m not trying to insult anyone here giving advice, but there is federal and sometimes state adjacent laws and protections that may be impactful to this specific situation). If you need help finding a legal office, DM me and I’ll help you locate one.

If her tech school orders move you to her tech school location then yes, you can break a lease early.

One caveat to be aware of, is the orders must be dated **after** the lease is signed. So if you get orders (such as to enter BMT) then sign a lease the day after (or any time after), you can’t then use those specific orders to break the lease under SCRA.

She hasn’t even graduated BMT, what if she gets reclassed?
