# Situation at the Pub ‘Inn’ in London

Hello everyone, seeking some guidance in this situation.

## Technical Issue with Keycard Access

We are currently staying at a pub ‘inn’ in London for the weekend, and encountered a technical problem with the keycard access door upon check-in. A staff member had to let us in from the inside through the kitchen due to the malfunction.

### Temporary Solution with a Brick

In the hallway, a staff member recommended propping a brick in the doorway to keep it open. Concerned about the security of this, I inquired about alternatives if the brick was removed during our absence. The response was to call the hotel manager’s number in case of such an event.

#### Unfortunate Midnight Incident

Upon returning late at night, we found the brick removed and were locked out. Despite multiple attempts, the hotel manager did not answer our calls. Stranded in London with no available rooms nearby, we felt compelled to break the window near the lock to gain access to our room. Unfortunately, this resulted in a severe cut on my hand.

## Legal Concerns and Seeking Advice

Are we legally liable for any repercussions? Given the circumstances, we felt we had no alternative options. Any advice on how to proceed would be greatly appreciated.

    Police officer here:

I think your defence to a criminal charge here is that you believed the owner would have consented to the damage had they known about the circumstance… god forbid it got to court you might get a magistrate to side with you and if you’ve got loads of call logs (save these) showing the efforts you went to and if it’s a £120 a night room vs a £30 bit of single glazed glass then this all seems more reasonable.

Hopefully a sensible conversation with the hotel will resolve it directly. I’d play a sensible request from them to avoid the headache.

I have to remind myself this subreddit has very tight rules, and whilst I personally agree that on the face of things, you appeared to be stuck between a rock and a hard place, what you ultimately did WAS criminal damage.

Yes you could get into trouble for breaking the window.

Was the window already broken prior to your arrival and you then cut your hand re-entering your room on the already broken glass?

Hmm possibly but that too would be illegal to claim, especially if it were to be proven false by CCTV.

I’d be Interested to get an update on how the manager responds to everything though so please do update us!

In my younger days I made this same stupid decision. I also left without telling the hotel, I panicked when I woke up. A few hours later I was contacted by the hotel and had to confess , they made me pay the damage but nothing else came of it.

I’d recommend reporting yourself to the hotel about the stupid decision you made and insists on paying for repairs. Sunday call out fees are going to hurt. You can only hope they don’t report you for damage.

There is a defence available to a charge of criminal damage, which is that you believed that the owner of the property would have consented to the damage had they known the circumstances.

Whether a court would accept that you really believed that is another question entirely.

I think your best bet here is to explain the situation to the manager of the pub immediately, wait around while they get a quote for someone to replace the window and secure it in the meantime (on a Sunday), and then pay them that amount of money and a little extra for their troubles, and hope they deem that a sufficient resolution and don’t pass your details to the police.

After you get back from A&E to treat the severe cut, of course, for which, on the off chance that this is the reason you mention it, the pub has no liability whatsoever.
