Potential Misdiagnosis and Its Impact on Disability Claims

The latest evaluation by a specialist suggests that the condition may actually be Acute Disseminated Encephalomyelitis (ADEM), necessitating a shift in treatment plans. They focus on how much your disability limits your ability to function, and is it severe enough that it prevents you from working above SGA.

They will focus mostly on documented symptoms & the severity of those symptoms. They need to see what limitations they cause & how they prevent you from working a full time job in any feild.

2 people with PTSD could apply for disability, & 1 get approved & the other get denied. There could be a 3rd person with PTSD who didnt apply at all because they are able to work. It all comes down to your medical records & how they prove your conditions prevent you from working any job.

    Medical records.

Absolutely symptoms and how they affect you and limit your ability to work. Whatever disability youÔÇÖre claiming, you should review the SS Blue Book requirements to meet the listing. TheyÔÇÖre very detailed and tell you exactly what they expect to see.

They focus on both. If you have not been determined to be disabled yet, they use a process with up to 5 steps.

Not a lawyer or affiliated with this firm in any way, but they have a good summary of the process.

Symptoms are considered at steps 2, 3 and before step 4. SSA requires that you have a severe medically determinable impairment before they consider how your symptoms limit your functioning.

The listings are step 3. Just because a condition is listed does not mean that you will be found disabled and likewise, a just because a condition is not listed does not mean that you will be found not disabled.

Diagnoses and treatment can change over time and changes will be taken into account, but it’s too complex a process for anyone who is not poring over your medical records and making that decision to know how the changes will affect your case. There’s no guarantee that everyone on infusions will be disabled, so there’s no reason to assume that stopping the infusions what your case will hinge on. It’s just one factor in a very complex process.
