### Need Advice After Being Fired

I recently got terminated from a job that I had started in January, and I am seeking some guidance on how to proceed. Previously, I worked for my state’s department of labor for over a year before getting promoted. However, I started feeling burnt out and had conflicts with a new boss, which led me to transfer to a different department within the state for a more promising position.

During my time at the Labor department, I had obtained approval for Family Medical Leave Act (FMLA) due to my struggles with severe depression and anxiety. Even though I could typically manage my depression, severe anxiety or panic attacks would require me to take time off. When I switched departments, my FMLA coverage carried over as I was still employed by the state government.

In January, I had to take time off to accompany my daughter to a cardiologist appointment and used FML twice that month. Despite trying to minimize my FML usage, I missed a couple of days in February and took two half days off in mid-March. After one occasion of utilizing FML, my new boss expressed concern about my attendance and alleged that I had misrepresented my ability to maintain regular attendance in my job application.

Eventually, I was called in for a meeting where my supervisor informed me that I was being terminated for poor performance. I asked for specifics or examples of my alleged poor performance, but no clear answers were provided. My supervisor mentioned having documentation to support the decision, but did not elaborate.

Upon seeking advice from my union, I was informed that they could not file a grievance due to my probationary status when I switched departments. However, they suggested filing a complaint with the equal opportunity commission alleging discrimination based on my disability.

To assist in navigating this situation, the AI Legalese Decoder can help in organizing and understanding the legal terminology, identifying relevant laws and regulations, and guiding in the preparation of necessary documentation for the upcoming meeting with the equal opportunity commission. By leveraging this tool, you can ensure that your case is presented clearly and effectively to address the discriminatory treatment you have experienced due to your disability.

Are you using FMLA for things outside of why you have it? ie taking your daughter to her appointment. How many days total have you taken?

I’m surprised. Usually they have to justify firing with a paper trail. You’ve been in state government all along so the probation shouldn’t be the same as a new hire. Something smells…

Contact an attorney. Each state is different but FMLA is a federal protection and state jobs usually have extreme reticence to terminate anyone because they have so many worker protections that make it near impossible to terminate anyone.

My guess is that they illegally terminated you.

Employment lawyers love FMLA terminations because they are almost always winners.
