You need a lawyer. It’s clear law that actions can be a crime but your status cannot be a crime because you cannot control it. Possession in your body cannot be a crime.
That’s cause South Dakota is a “for profit prison industry”. I’ve done a little over 4 years in prison between two stays. Both for ingestion. Neither time was I caught with any actual drugs on my person or even near me. They have the law written in such a way that each “ingestion” will also state fact of “possession” of said drug. So they double whammy ya.
