Unsure about Payment: Seeking Assistance from AI Legalese Decoder

I am currently facing a predicament regarding payment for my insurance contract, and I am no longer certain whether I should proceed with the payment. The reason behind my uncertainty stems from conflicting advice given by my current counselor at a different insurance company, who claimed that I should not make the payment. However, it has come to light that this counselor failed to cancel the insurance contract for my apartment, which was revealed by Allianz, the insurance company, recently. They informed me that the cancellation was refused because the contract stated that it was impossible to cancel within a year, and unfortunately, that was the case at the time. Interestingly, I do not recall receiving any notification regarding this issue.

Complicating matters further, Allianz did not terminate my contract for a considerable period of time. Consequently, they are demanding payment not only for the remaining months of that year but also for another year, despite the fact that I no longer resided in the apartment nor utilized Allianz’s services.

Given the convoluted nature of this situation, it is definitely confusing. Moreover, I have been enduring mental and physical hardships, coupled with a stressful situation in my homeland as I am a Ukrainian refugee. Consequently, paying over 200Ôé¼ poses a significant challenge for me, particularly since I am currently unemployed and recently graduated from university. Furthermore, I am still struggling to adapt to how things work in the EU.

In light of these circumstances, I am eager to explore options that would allow me to avoid the payment without landing in legal trouble. I am also concerned about the fact that neither I nor my current insurance agent were notified about the refusal to cancel my contract. Considering that I was paying for two apartment assurance contracts simultaneously, it is evident that I am facing financial strain. While contemplating a potential lawsuit against Allianz, I am skeptical about whether it is truly worth the hassle and potential costs involved.

    You cancelled your contract.

They told you, you can’t cancel the first year.

    Ok, that’s possible.

But, you’ve cancelled your contract so that there wouldn’t be a contract after that 1st year.
Pay for the first year, not the rest.
Exception. You were to late with cancelling and had a contract renewal. I don’t know wether the European law about automatically elongation and cancelling every month is valid here.

You will have to pay it as you were contractually obliged to do so. If you have legal insurance see if they can claim the costs from your current insurance agent. But do pay the bill as Allianz will pursue and it could cost you lots more if you refuse to pay.

OK so just a few questions first to clear things up: who exactly cancelled the contract? Did you do it or did the insurance broker do it for you? And if so, whose contact details did Allianz have? Yours or theirs? Because if your insurance broker was supposed to handle the cancellation and didn’t read up on the terms or ignored any replies by the insurance, he could be held liable for any outstanding amounts.

The wording might also make a difference, meaning if the cancellation was requested for a certain date or was worded similar to “I wish to terminate the contract effective February 16, 2023 or at the earliest possible date”.

If the cancellation was worded clearly and they sent out no immediate confirmation to anyone then I would fight with them about paying the second year. Just send them the original letter again and tell them that you have no intention of paying for the second year since you have cancelled your contract within the notice period.

If you donÔÇÖt posses anymore the good that is insured, in this case you have closed the contract, the insurance is nullified and if you already payed the entire year you mist be given back the money related to the remaining months.

So it all depends on if you can prove you no longer posses the good. If you simply left the apartment, but the contract is still to your name, and you didnÔÇÖt cancel the insurance in the legal time, you are obliged to pay.

Otherwise you have to pay untill the rime you give communication to the company that you donÔÇÖt posses the nsured good anymore. Informing them you donÔÇÖt posses the good anymore is your responsability.

Also, even if itÔÇÖs not legally stated, insurance company usually have a period to cancel the contract that is from 30 to 90 days from renewal, an year seems too mich and itÔÇÖs not the habit of Allianz.
