### Situation in South Carolina

This is in South Carolina if that matters.

### Background and Current Situation

Been married 13 years. We moved out to the wife’s family’s property 4 years ago. They have 12 acres. They “cut out” a 1-acre parcel for us to put a new manufactured home on (though said we can do whatever with all the land except near their house). We were looking at property but they insisted, and said we can save a bunch of money on upfront land costs and get on a large piece of land essentially for free. The only thing we couldn’t do was tie the loan to the land so I had to get a chattel loan. Their reasoning is that should something happen, like I lose my job, they can only take the house and not the land.

Well, it turns out all of this was planned that way.

### Current Concerns and Suspicions

Wife and I have been having issues, and it’s getting to the point of divorce if we can’t rectify things. Or rather if I even want to at this point. Because now I see her and her parents have been manipulating me for over a decade, to get exactly what they want. That goes for essentially funding their move out of state into SC, and then moving us up here.

I found out recently that the reason they did this was so that they could evict me from the land should my wife and I divorce. And I believe the plan to divorce has been in motion for a few years now and she’s waiting for the perfect time. I think the plan was to get me to fund the house out onto the property, and then save a bunch of money on the side and kick me out.

I’m pretty sure my wife has been carrying on an emotional affair and her parents have been covering for her. I’m not sure if she would be dumb enough for it to be physical because in SC she would lose everything if I got proof of that.

### Financial and Legal Concerns

The problem is, I don’t make enough money to fund two homes, so I would have no choice but to stay in the house. However, would my in-laws be able to evict me off the land? I know when we got the land situated with the city, we had to sign a paper, along with the in-laws, stating that we lease the land from them for $1 per year since their names are still on the land deed.

Also in SC, they require separation for 1 year unless you can prove abuse or infidelity.

### Seeking Advice and Assistance

Does anyone know how this would work? While staying is absolutely not something I look forward to, I’m a person of strong principal and the idea that they manipulated me for years to serve their own needs and toss me away like a used up piece of trash really burns me up inside and I would like to figure out how to at least fight this issue if possible.

I know this is likely some sort of tenant law issue but I was wondering what rights I have and if there’s something I can do preemptively to halt the process or even stop it from beginning?

If they can evict me, how does that work for my property? Since it’s not exactly easy or cheap to remove an entire house.

This all depends on your land lease with the in-laws. You need that document. It will tell you who and under what conditions that the lease can be terminated.

Now, on to what I would personally do in your situation. Tell her to leave, separate and file for divorce. If this is truly a situation where you think that there is a bigger plan afoot, then by all means get the hell out.
