## Child Support Situation with Ex in Ohio

I currently have a child support order for three kids with my ex-partner. In Ohio, she has the ability to request a review of the child support order every three years. When the original order was put in place, I was earning significantly more than I am now – about $3000k more.

## Change in Income Due to Education and Loans

Recently, I decided to go back to school in 2023 through a program offered by my workplace. This program provides assistance for furthering education, but required me to take out a loan to cover some of the costs. While my company covers half of the expenses, the other half becomes taxable income for me.

## Concerns about Child Support Review

My main concern is that during the upcoming child support review, the income I made last year, which included the one-time extra taxable income from the loan, may be considered as regular income for the calculation. This worries me because the income from last year is not something that will continue into this year.

## Fear of Unaffordable Child Support Increase

I am anxious about the possibility of being ordered to pay more in child support every month, even if I cannot afford it due to the irregular nature of my income. This uncertainty about potential increases in child support payments has left me feeling terrified about my financial situation.

Courts often will look to three averages when there are anomaly years. So while it may be likely to increase, it wouldn’t increase as much as you may think.

Side note – How is a loan considered taxable income? If you’re talking about the portion your employer is paying for the training, can you not just get them to pay their portion directly to the training provider? Why go through you and have it be taxed? Makes no sense.

Your income went down $3000? That’s not significant and I wouldn’t expect to even see a reduction. The other parent could get a cost of living increase.

A loan shouldn’t be considered as income. Typically CS calculations use your recent pay stubs.

If it was a bonus, that would be different.

It won’t lower, I can tell you that. Even if you lose your job and make considerably less than when you were first ordered to pay. Atleast not where I’m from. I’ve spent the last 2 decades unable to make enough money to survive. Thankfully I have family & friends that are caring enough to help me out
