## Filing Taxes as a Military Spouse in a Different State

As a first-time filer, you may feel overwhelmed by the complexities of filing taxes as a married couple with one spouse in the military. Being stationed in Hawaii while originally from Ohio adds another layer of confusion to the process.

One common issue military spouses face is how to handle state taxes when their job location changes. In your case, your job in Hawaii has stopped withholding Hawaii taxes from your paycheck. This raises the question of how to pay Ohio taxes on income earned in Hawaii.

## How AI Legalese Decoder Can Help

Using the AI Legalese Decoder tool can simplify the process for you. By inputting your tax-related questions, the decoder can provide easy-to-understand explanations in plain language. It can guide you through the steps of filing your federal and Ohio state taxes on TurboTax, as well as separate filing for Hawaii using the N-15 form.

Additionally, the AI Legalese Decoder can clarify how Ohio taxes on Hawaii income are managed. It may explain that Ohio taxes will likely be calculated based on your total income, including income from Hawaii. This means that when you file your Ohio taxes with your W2 from Hawaii, the necessary adjustments for out-of-state income should be accounted for.

General overview of what you need to do:

    1. Highly recommend using H&R Block products through [MilTax](https://www.militaryonesource.mil/financial-legal/taxes/miltax-military-tax-services/) – free for federal & state filing, military friendly, and there are branches located on many military bases to assist with tax filing.
    2. File a joint federal return for your federal income taxes; as part of this you’ll declare Ohio as your & your spouse’s state of legal residence because you’re living/working in HI solely due to active duty military orders. OH state income tax rates should be better for you than HI, so I agree with your decision to maintain OH residence (though do consider adopting residency in no-tax states like AK/TX/FL if you move there in the future)
    3. File a non-resident state return with Hawaii to get a refund of all HI state income tax withheld from your job in Hawaii. You have no HI state income tax burden from normal W-2 employment because you’re a military spouse solely in HI to be with your active duty spouse. H&R Block will walk you through how to receive this refund – unfortunately it’s not as simple as “pay OH taxes with HI withholdings”, so you may owe payment to OH in the following step even if you’re receiving a refund in this step.
    4. File a resident state return with Ohio to calculate your OH state income tax burden. If your job in HI did not withhold state taxes for OH, and your husband’s military pay withholding wasn’t enough for both of you, it’s possible you’ll owe OH taxes. H&R Block will walk you through how to pay any underwithholding amount/possible penalties. H&R Block will also walk you through filing multiple state tax returns as part of one single tax year filing – no need to do it separately.

You should work with your employer in HI to withhold OH state income taxes going forward (update a State W-4 form) to avoid underwithholding in the future. Good luck!

Military one source is a fantastic resource for things like this.

Judging by your name…you went to Miami?

My wife and I (both from NE Ohio, wife is a Miami grad) k-bay/pearl was our first duty station. We really loved living in kailua…10+ years ago.

Have your husband check out military one source, it’s free tax help, or check on base, free tax help too.

If you claimed exempt on your w4 and your employer is not withholding Hawaii taxes, you can claim your husband’s legal residence (OH) and pay the quarterly taxes. Hit up military one source to verify with the tax pros. But yea should be under the MSRRA law. Double check which is lower state income tax Hawaii or OH.

You don’t pay Ohio taxes if you live in HI. Of course it depends on when you moved there and if you worked a little bit in OH then to HI then worked there.

Every state is different but “generally” the service member is a resident of a different state, so they don’t pay taxes in the state they are stationed in. I’m pretty sure if you are stationed in OH, then you pay OH taxes. There is a federal law (don’t know the name of it off the top of my head) that does this for spouses too.

My wife had taxes taken even though we didn’t owe anything because we’re technically not residents of the state. We filed the taxes for the state she worked in, manually through the mail and got it all back.

Also recommend Kathy with werner financial advisors for tax filing. We use her, she’s fantastic.

When I was active, my home of record was OH…I paired the tax an received a 100% refund on it.

I suppose some portion of the year you lived in OH and had a job there? If not claim HI as your home of record and pay their tax.
