    Is it REALLY in your conditions? Have you read 35 miles? I’ve never heard of that.

    I’m looking at my conditions and it says nothing of the sort. He claims it was a new program that was signed by them 2 years ago. I’m trying to schedule an appt to go in to see this paper and see what I can do… I have to watch out for myself but this guy is a jerk and I know he’d try to retaliate.. I’m ready to give up and say wtf do u want from me. .. I can’t change the past I can only try to be a better pereson..

    You need an attorney. They can’t possibly expect anyone to stay 35 MILES from a victim. You’d have to know where they are 24/7 to even begin to comply with that.

    This is going to be a CDCR policy, and I don’t think it’s in the penal code. You probably could file for a modification of this condition, but you also could file for early termination too.

    You need a lawyer. I cannot see how this would be legal. There is no way they could justify a 35 (or even 25) mile exclusionary zone is necessary for the safety of the victim or general public.

    Not only isn’t capricious, but there is no way for you to k ow at any given time.if you are complying

    That seems incredibly hard. I can understand staying 1000 feet away from a school, no contact with the victim, etc. but you can’t live 35 miles from them?? Like unless you live in a big/medium city, it kind of sounds like they expect you to uproot and move to an entirely different city… Or live on the very edge of it..
    Even 25 miles would be excessive..

    Does your PO know the victims current address? Do they even still live at that address? Like what happens if the victim decides to move – do they have to call your POs or sheriff’s office to say they have moved? Hell, what happens if they move CLOSER and don’t tell anyone??

    They know full well just how hard it is for ANYONE to just up and move, let alone an SO.. I swear like… What if you were homeless and the only homeless shelter was 34 miles away from their address and not 35???

    If it’s a parole/DOC condition, try and appeal it, and/or seriously file a grievance on your PO that they let you live there for TWO YEARS without even bothering to check. That’s their whole damn job afterall, to make sure you’re in compliance..
    If it’s Court ordered, not by Parole/DOC, absolutely get a lawyer and fight your case. Bring up logical questions like, what happens if the victim moves closer/away? Are they required to update their address just as you are? If they don’t report where theyre moving/newly living, how can you be at fault?

    When he called me yesterday the way he worded it was like this okay I’m going to take away 11 or 12 of your restrictions but I’m going to impose a big one on you what the hell how can I even be like that. I have no idea what to make of this guy I’m looking at my restrictions all I have is like 11 or 12 so this guy is going to let me run free run amok as long as I move this doesn’t make any sense.

    **Update** i met him yesterday and we got into a yelling match I told him I need at least 3 months. And he said fuck no I’m not giving you 3 months. I basically went of on him saying he’s the only guy giving me issues and it’s not my fault they can’t do their job correctly but because of them I’m suffering. I told him I’ll just quit my job and go transient and it will be because of him. He started to change his tune saying oh you can’t quit and I’m here to help. I was like no your honestly not. I said he needs to help and he was like I don’t have to do shit. You just need to find a place now. I said how TF can I look if EVERYTHING needs approval this should have been done before I get out. He’s like ok send me lists of what you find and I’ll review and say yes or no if the location is ok. Then he says I’m off on weekends and Monday is a holiday.. this guy is fucking driving me crazy. He’s got some sort of vendetta but at the end I know I’ll get stuff done I won’t let him win. I’m going to flood him with listings and make him look at each one. If anyone has any support or suggestions for living in LA around Koreatown or West Hollywood or Los Feliz id appreciate the help.. 🙁 trying to stay positive but it’s not easy.thank you everyone for reading and for your support.
