Divorce After 26 Years: Seeking Financial Security

Introduction:
After being married for 26 years, I found myself going through a painful divorce when my ex-husband decided to marry his coworker. As a stay-at-home mom throughout our marriage, my earning capacity was significantly low. Meanwhile, my ex-husband, who is employed by the Federal government, has been earning a substantial annual income exceeding $100,000. In search of financial support, I contacted the Social Security Administration (SSA) to determine what I could expect to receive as my share of his Social Security Income (SSI). However, to my utter shock, I was only told that my monthly entitlement amounted to $700. This revelation has left me not only shocked but also terrified about my financial future. Is there something that I’ve overlooked? Though my ex-husband and I do not communicate, I would appreciate any insights or advice anyone may have regarding my situation. Thank you.

Seeking Fair Compensation: The AI Legalese Decoder as an Aid

Divorce after such a long-term marriage can leave one grappling with the financial aftermath, especially for those who were primarily homemakers like myself. Understanding that I am entitled to a portion of my ex-husband’s Social Security Income, I reached out to the SSA for an estimate of the expected amount. While my ex-husband’s current employment status has been verified, it would be beneficial to explore any potential changes in his income or legal circumstances that could affect my entitlement.

You need your own plan for future.

How long has he been a federal employee? I ask because there are two pension plans. Civil Service Retirement System and Federal Employees Retirement System. FERS employees are covered by Social Security and CSRS employees are not. I believe that people hired after 1983 are covered by FERS.

But hearing how low his Social Security Benefit amount is, I suspect that he is covered by CSRS. Which means that any Social Security taxes he paid would have been from other jobs.

In my case for instance. I worked 42 years at Social Security where I was not covered by Social Security but CSRS instead. I had other work during college and some part-time work too. So my main source of income is the Federal pension. My Social Security check is $300 per month.

It sounds like that’s his situation too. Though you would have to check.

If so, you will collect as a former spouse on his Federal pension as long as you were married longer than 9 months and you (not him) have not remarried prior to age 55.

Find out which system he is under and if it’s CSRS check with the office of personnel management for specifics

Just went through this with a family member. She doesnÔÇÖt have work credits and was married for 20 + years. Divorced in 2013. She gets $500/m from SS, but she also didnÔÇÖt have expectations of anything higher.

  • ScratchMorton

Similar story here, but before I was divorced, I went to the SSA website and plugged in his info to get an estimate of his benefit. With that amount in mind I was able to plan ahead. I was unemployed for most of our marriage (26 years) but qualified on my own record and now some of his too. Good luck getting your due.

  • GeorgeRetire

Did your divorce lawyer take his work and pension into account?

  • oregon_deb

How about talking to an estate lawyer – maybe they can help figure out the retirement funds questions ?

  • forgotme5

Sounds right for ssi. Never heard of ssi being 2k. My ex husband did the same I suspect bc i refused to have his kid. I made more money than he did.

  • srtking6

I just wanted to say I’m sorry your ex husband cheated on you…and with the coworker..smh you will be fine good karma is coming your way. God bless you

  • ksdorothy

You need to be earning your own work credits so you can get Medicare at 65. Otherwise, it sounds like you will end up with part his retirement and part SSI. If you are on aged SSI, you only get state funded Medicaid. As we all know, every state is trying to dump their Medicaid rolls. Go to work ASAP.

  • RhubarbPiePie

CSRS is a good guess. But he would have had to have joined the federal workforce more than 10 years ago. CSRS was phased out as of 1987. How old are you? If below FRA, the amount you will receive will also be reduced for age. My guess is that his RIB is somewhere between $2000-2500/mo and is then being reduced for your age. But need more info to actually know for sure whatÔÇÖs going on.

  • tsidaysi

My advice is go to a junior college and look at training programs. You divorce should have granted you part of his pension.

    Read the papers carefully.

  • Big_Daddy-59

First you need a good lawyer.

  • yankinwaoz

    Sounds like GPO kicked in.

  • Few_Efficiency2188

Can my wife claim on my ss retirement of were separated? Does that reduce what I get

  • Few_Efficiency2188

    Thank you!

  • JABBYAU

Please find a copy of your divorce decree and read it. It should clearly spell out the pension details of a federal employee. Social security payments are likely to be small. Many payments disallow them all together even if an employee paid taxes into the system early in the career. Have you been working for the last 8-10 years? Are you going to work until full retirement age of 67? Your SS employee benefits may be greater than his.

what about health care benefits? Where will those come from?Medicare? Do you have care through pension?

(My aunt faced a similar situation complicated by religious issues. And wasted many years nursing her grievances instead of working. Her retirement was not happy. So please figure out the path now. The income from your spouse should be a supplement to your own work.)

  • CaregiverFair7883

dont you have to be disabled to collect off of an ex spouse or 65 or something. idk i never made the 10 year mark mde my own

  • Proud_Combination755

Had you reread your divorce agreement – start there to see of you perhaps waived. How have you been surviving?
