    If I was the judge I would be asking myself the following: (note, I am not a judge)
    – Were there safer/better options available to the family to live in? Why did they choose this house in this street? (Note the current rental crisis)
    – Has the house with all the fighting had children removed by DCP? If so, is it reasonable to say that the shenanigans at the house prove an unsafe environment for children to be present? (Depends WHY the kids were removed, if kids are still living there and DCP is involved then why is it deemed ÔÇÿsafeÔÇÖ?)
    – What is the parent of the children of your client doing to protect their mutual children from this ruckus? (Sleeping bedrooms away from the offending house, not playing in the street or yards when things kick off, involved in community activities outside the house that keep them away and give them positive role models elsewhere – art, sport or community clubs sort of stuff)

    – How long is the lease and is the parent aiming to move (no one intentionally would live next door to that chaos, so they probably didnÔÇÖt sign a legally binding contract in the full knowledge they were moving in next door to Hades – what are they doing to either get out of hte lease, or at least not renew it).

    Using a desperate personÔÇÖs need for housing and swamp hole finding of a house thatÔÇÖs in a rough area as grounds to alter custody arrangements/gain custody arrangement advantage is a pretty low move, and if itÔÇÖs ALL the other party has as a reason itÔÇÖs probably good evidence that the child support needs to tip in the favour of the parent living in the difficult circumstances. This can backfire that way too.

    Why doesn’t the client apply for orders?

    I mean, it’s pretty hard to work out how you determine that having shit neighbours is grounds for withholding children.

    What frequency are we talking? Every night? What constitutes “danger”?

    I found a syringe last week on a walk, am I living in a dangerous area? What if I’m one suburb away from the higher crime area? Does that count?

    Australia isn’t some warzone. People being poor and forced to live in less-than-desirable neighbourhoods is a hard line to take regarding the care arrangement.

    Courts generally don’t act on the voice of parents projecting their own fears and issues. I have this conversation with my ex **frequently** because she’s anxiety-riddled and uses any fear she can generate as fuel.

    The parental responsibility, care obligations, and duty of care (etc.) do not get waived because 1 parent is seeing potential problems.

    The court’s obligations will be “what’s in the best interest of the child?” and – generally – the best interest is that the children have sound relationships with each parent.

    If the children’s needs are being provided for I don’t see this claim working out for the client.

    Client should pay to move them to another area. There is a crisis so instead of with holding care, move them and let the care continue at their own cost.

    Has there been any indication the kids have been affected or care what the neighbours are doing?

    Maybe you as the adviser could speak to the local police for their professional unbiased opinion .
