I can see how technically this could be seen as civil as the offence of theft may not be wholly made out, there would need to be proof that your father dishonesty appropriated the passport; if it’s agreed that he keeps the passport for safe keeping the initial appropriation was not dishonest, however if he is refusing to return it then it could become dishonesty appropriated. So it’s a bit of a grey area.

    However – even if police attend to speak to him and he says he could say he doesn’t know where it is, may not allow them entry to his house or completely refuse to engage, even if he is arrested as summary only offence there is no policing power to search his house.
    Depending on what your relationship with your father is like my first recommendation would be to speak to him and see if he will engage, or is there a family member/family friend who would be willing to advocate on yout behalf?
    The final option would be to report it lost/stolen snf apply for a new passport, which of course will come with a cost which is fairly expensive these days.

    Just wait for your dad to leave the house and then go find and reclaim your passport. Check his closet, too to bottom, dresser drawers, ender the bed, under the mattress etc.

    Ideally be as neat as possible so he doesn’t suspect you went through his stuff to find your stuff.
