Didn’t see the required location in your post.

In just about everywhere in the USA, dogs are property, not unlike a TV or coffee table. They’re *owned*, by one person, or more than one person.

    > all I got was a crazy phone call from her mom telling me I was out of my mind.

Threatening to involve the police in a civil matter might be what did this. The cops aren’t going to help you here, and *you* don’t file criminal charges, the DA does, which they’re not going to do over a civil dispute.

    > I’d go as far to say she’s emotional support for me.

Your therapist would need to write a letter of recommendation in order for this animal to be legally considered your ESA. Having your therapist do this *may* not affect, one way or another, your ability to get the dog back.

    > what is my chance of winning custody?

Zero. There’s, almost always, no such thing as pet custody except in very few places as an outcome of divorce.

What you might win is the value of the dog (which could be shockingly low, unless this dog is incredibly high-value or purebred or something), or in some limited cases and places, the return of the actual dog.

Your main option is going to sue her for the cost of the dog in small claims. Pet custody really isn’t a legal concept outside of divorces in a couple states.

You can also try a replevin suit to try and force her to return a dog, but that’s complex enough it probably requires an attorney (if it’s even possible at all in your state).

YouÔÇÖre going to end up having to take her to court. My ex did this to me too. He took the dog and wouldnÔÇÖt respond to me either after we agreed to share him. I paid for the dog and the vet information is in my name. HeÔÇÖs also registered with our county to me. I filed in small claims to get him back and won about 2 weeks ago. Make sure you have all of your receipts and everything and if you can contact the breeder and see if they can sign a paper stating that you were the one they communicated with as far as purchasing the dog.

It’s very unlikely you’ll get the dog back. You might consider adopting another dog when you are ready. I’m sorry for what you’re going through.

ThereÔÇÖs no such thing as ÔÇ£custodyÔÇØ of a dog (or a cat or any other pet / animal) in the vast majority of states. (I see youÔÇÖre in PA, which is unfortunately *not* among the states that view pets are ÔÇ£more than property.ÔÇØ Sorry.) Even among the small handful of states that might entertain the idea of awarding ÔÇ£custodyÔÇØ of a pet based on the animalÔÇÖs best interest or similar factors, this type of analysis typically only occurs in divorce proceedings where itÔÇÖs undeniable that both parties jointly owned the dog.

That said The fact that you paid for the dog is a good fact for you. Pennsylvania views the dog as property, so if you paid for it, it should be your property. Who covered other expenses related to the dogvet bills, food, pet sitting when you went out of town, grooming, *etc.*? If you can provide proof that you bought the dog *and* that you incurred most or all of the other expenses, you may be able to sue to get the value of the dog back in small claims court.

  • Illustrious_Debt_392

Who is the dog licensed to? I’m in NY, so rules may differ, but here the dog belongs to whoever it’s licensed to. Keep in mind that as much as we love them, animals are property, not children.

  • PaprikaThyme

As somone has said, pets are property. If you’re going to want to fight this in court, you’d probably need to prove *current* ownership: like veterinary records, microchip, vaccination records, etc. Who has been taking the dog to the vet? Who has been paying the vet bills? Who is the microchip information registered to, etc. Who bought the dog 18 months ago will be less relevant than who has been taking care of him since then. Gather this paperwork to bolster your case.
