    I think fraudulent would be making claims that didnÔÇÖt happen in the military, but saying it did. Like saying you have migraines when you donÔÇÖt, or something like that. Or claiming that youÔÇÖre worse then you actually are during c&ps. IÔÇÖm pretty sure there was a case where a guy claimed he couldnÔÇÖt do anything physical or something, and got 100%. Then he became a professional body builder and competed in competitions and stuff, then the va found out and he went to jail. Someone can correct me because IÔÇÖm sure IÔÇÖm not completely accurate, but it was something along those lines.

    With joints, the law provides for such fluctuation, and that is why they try to figure out how bad your function is when it “flares” or when you have been using it for a while. And, yes, the rating offices will sometimes reduce a rating without much thought, but those should ALWAYS be appealed because they hardly every do it according to the law. There has to be sustained improvement in ability to function, so even if your range of motion is better, does that really mean you can do a bunch of stuff that you couldn’t before? Most likely not

    Some days I need a cane. Some days I walk ok without one. Do what feels safe within your limits. Be careful trying too hard to get better. Unfortunately if you are rated static it is not likely to improve. Definitely stay active and live your life but be careful not to push yourself. These morons getting caught up in fraud crap are not just working out. They are bodybuilding and plastering it all over the internet. Don’t let some knuckleheads keep you from staying healthy.

    I do power through some of them to get through life, and to try to enjoy myself. Otherwise I would be stuck at home.

    VA has to take ALL medical evidence of record into consideration – even with reductions. So, if you have a ÔÇ£goodÔÇØ day on the day of exam, and your medical records provide info that you have more bad than good, then there should not be any grounds for reduction.

    I broke my back and was told to bulid my muscles to stablize it, doesn’t mean the problem magically will heal, but it’ll prolong the progression of things vs if I don’t do anything about it. This was told to me by a VA physician, so yeah they expect you to maintain your body to a point with in its limits etc. you won’t see me climbing walls or even running but at some point I want to be able to walk without a cane even if it’s only a few hours a day. I’m not gonna go and get a reexamination for what is probably helping me get around better, because the underlying issues I have aren’t gonna go away and may worsen in the next couple years if my degenerative disc disease progresses and doesn’t allow me to do anything I can today.

    Also, is that degree out of criteria with or with out medication? I donÔÇÖt see anywhere in the cfr where it says c/p exam with meds.

    You are over analyzing it a bit. Static refers to an injury that isn’t going to miraculously heal. Say, if you have a wrist fracture that leads to artgritis and what not. There are countless ways to improve range of motion and reduce pain: acupuncture, physical therapy, strength training, GrandmaÔÇÖs herbal remedy, anti-inflammatory diets, yadda-yadda. But, that injury is never going to go away completely and if you ignore it, or treat your health like shit, it may worsen.

    But, you shouldn’t have to worry much. As has been said already, reductions are almost never done correctly and almost never justified. Any time I see one my assumption is that I will reverse it. I’ve only had to uphold one reduction and I felt awful having to do it.

    They want you to get better, and you should too. Disability honestly should not be something people actually want to have. I’m 80% right now and have held down two jobs for about a year each in over ten years. Everyone keeps telling me to go for 100%, but to be honest, I’d prefer to have zero percent and be a functional member of society. If you get better, good for you, to be honest. I truly hope you do get better.
