    If this is correct, get all the women to complain at the time of sex discrimination, together. That’ll throw a big spanner in the works, and make it unlawful to dismiss them for complaining about it.

    1. The employees implied duty to confirm with a ÔÇ£reasonableÔÇØ management instruction

    2. The employers implied duty not to be arbitrary, capricious or unreasonable

    (Reasonable – are there more reasons for than against, and is it generally in good conscience of other similar employers ie the band of reasonable responses)

    You point out very good arguments relating to sex and I encourage you raise a grievance. You should have protection from dismissal due to sex being a protected characteristics.

    I think itÔÇÖs probably reasonable that searches are done by the same gender and more so if it is quite a personal or intimate search although I am not an employer or tribunal judge.

    Just to add as it hasn’t been mentioned- searches must take place BEFORE you clock out. If it was a small place with a handful of workers itnwouldnt be an issue but Sports Direct got absolutely reamed a few years ago by HMRC because staff were being forced to clock out and then waiting for 30 or 40 minutes to be searched.

    What does your contract of employment say? If it says you have to submit to searches then you agreed to it when you signed your contract.

    If you don’t submit to it then you are probably going o be sacked.

    Having said that cross gender searches shouldn’t really be happening but as far as I know it’s guidelines not law.

    Although OP probably needs to provide a bit more info, keep in mind that generally a witness is a Cctv lot of the time and the employee pats themselves down, no contact from security guard or manager.

    Firstly tell HR that she is uncomfortable being searched by someone of the opposite sex. It also should not be done anywhere too private I.e. in a room where itÔÇÖs just the 2 of them. Put it in writing to HR.
    Point to the government guidance and tell them you are happy to comply but the guidance needs to be followed.
    If this is a national chain they will more than likely oblige immediately
