    I am an attorney but not your attorney. I work specifically in this area of law. Very likely there is a provision in your Declaration/Rules which restricts vehicles with non current registration and permits towing. If you do not have a copy, request one from your Board/management company or check the county recorder website. These documents should be recorded with the county and you can access them that way.

    It depends on your jurisdiction but it is my understanding that would not necessarily be legal in most cases. But that would really depend on the towing laws in your area and those are often a bit more difficult to look up than other types of laws because both civil and licensing rules will apply. It may not be explicitly permissible under civil laws but it might be permissible under the licensure rules of tow truck drivers. Although those rules may only apply to repossessions and may not actually apply to a standard tow.

    The problem is, tow truck drivers and tow companies are generally shady AF and your level of recourse may be very difficult to deal with it after they do it anyways…

    Yes HOA can tow your car from your property if it’s in the rules. I’ve seen it happen multiple times. Vehicles towed from their assigned parking spot because the parking tag was hung incorrectly. Correct vehicle, correct parking spot, correct tag. Still towed because it was not hung properly.

    Personally I would get it towed to a storage facility, you’ll be out a couple of hundred but it will buy you piece of mind till the title situation.
