Yes. You can still get fined.

Window tint doesn’t have a serial number or date stamp like guns or other things for legality from a law at certain time.

Unless your window is factory tint/privacy glass and not filmed you can still get a ticket no matter when it was applied.

Maybe get it professionally tested to be sure? If it’s been sitting in a garage for years certainly there is a lot of dust on it.

Also, is it over 25 years old? You may be able to get around the tinting issue by registering it as an antique vehicle, but then there are restrictions on how its used:

*To qualify for Antique Plates, motor vehicles, including motorcycles, must be more than 25 years old. Firefighting vehicles must be at least 20 years old.*

*Vehicles displaying these plates may only be driven to and from an antique auto show or exhibition, service station or demonstration. The mechanical and physical condition of the vehicle, including brakes, lights, glass and appearance, must be the same or as safe as originally equipped. An antique vehicle may be a “bona fide replica” – an exact copy of the original in design, frame and mechanical operation. “Facsimiles” – close, but not exact, reproductions of the original – do not qualify for Antique Vehicle plates.*

I just re-read this, and 5% is really very dark tinting. Many cops don’t like this amount of tinting because they can’t see clearly what’s happening in the car. If they can’t see who is in the car during a stop, or what that person is doing, they can get worried for their own safety (how many people are in the vehicle? did that guy just reach under the seat??). Especially in an older model car (as opposed to, say, a limo or other livery).

Making police officers nervous for their own safety is not a good life plan – aside from the “health risks”, they tend to be less forgiving on other infractions if you make them nervous, or cause them to call in backup. I’d take the tints off…

doesnt matter when it was done, if your driving it on the road today then it needs to be legal today

Do you have legal proof it was tinted before tint was declared illegal? Just askin’.
