Garnishment Nightmare: A Florida Debacle

The Backstory

I am curious about the type of attorney or action I can take regarding the situation with Florida, which claims I owe $4,400. To add insult to injury, I’ve been having my checks garnished every two weeks since 2016 for $341. This financial burden has been weighing on me for years.

The Complicating Factors

The mother, who lived in Tennessee, recently moved to Florida, which has added an extra layer of complexity to the situation. Interestingly, in 2020, the case worker informed me that I was actually overpaid by around $700. I decided to let the issue slide, hoping that it wouldn’t escalate into something more serious. Unfortunately, Florida’s subsequent actions have been nothing short of frustrating.

The Runaround

Florida’s bureaucracy has been uncooperative, refusing to provide me with specific details on how the debt has become past due. It’s as if they’re intentionally stonewalling me, making it difficult for me to resolve the issue. The lack of transparency and clarity has left me feeling overwhelmed and anxious.

Your point of contact is still Tennessee. Tennessee is still the final arbiter of arrears. Contact your Tennessee caseworker and tell them that Florida is saying you’re behind, but you don’t think you are.

Your payments are still made through Tennessee, and then Tennessee forwards your payments to Florida. Florida then disburses the payments to mom

Thanks for all the information guys. This morning I made all the calls. So I am actually overpaid and Florida I guess has been trying to get some paperwork from Tennessee and I have now got both working on attempts to speak with each other on the phone. It’s strange that Florida took actions though against me for passport travel and was about to go further which is wild. Hopefully it’s all sorted now, but was having panic attacks all night over this. Thanks 🙏🏻

Go to the county clerk of court and request a payment receipt log, thinks its $3-5 to get one.

if you have beeb keep records see if it matches and if not petition the local CSE for their records or contact the AG and file a complaint.

“I need some clarification on the child support paperwork did you received from the Florida child support agency. Or babe mom hired a family lawyer to request payment without going to court.

You need planning to visit the Tennessee child support office don’t call with my W2 and the lawyer’s paperwork to request an audit and clear up any confusion. After that, you will send via certified mail to ensure that they are properly received and accounted for. I have also notified my child’s mother that she needs to update her mailing address since transferred the child support case from Tennessee to Florida.”

If you got a child support order, and your childs mother moved the child out of state, she was supposed to notify the court as well as get your signature/approval & a new order should have been created. When theres a child support case & the two parents live in different states, the child support will always go off of the original state of the court order, so Florida really has no say in the matter as they are actually a 3rd party if theres already a court ordered amount sent in place. Also would like to note that, even though your paychecks have been garnished since 2016, employers are only allowed to garnish a certain percentage of your paycheck, and any remaining payments are up to you to pay on your own. So if they’re saying that you have past due amounts, its possible that those accrued since your employer was only garnishing what the legal amount was, and you havent paid the additional balances off every month. Most people have to call the payment in, or go & pay online. I hope that isnt your case though and maybe its just a clerical error. Best of luck!

Fl is messed up 😆 I agree with someone above saying to request payment history from the original state and get it sent over to fl.
