AI Legalese Decoder: A Valuable Resource for Understanding Tax Withholding Requirements in Contracting Work
Introduction:
Contracting work has become a popular side hustle for individuals involved in creative fields such as editing and writing, particularly for ministries seeking specialized services. ****** just grabbed a
Are you working in TV/Film? that’s a legal requirement on their end.
IRD forces it on a lot of contractors (individuals) in certain areas. they also force it on some companies (labour only, building industry)
Check out the IR330C form at IRD.
You have to apply for an exemption with IRD to stop them doing it. Our accountant does something with IRD to get us a tailored tax rate 0% certificate.
I understand if youÔÇÖre not company and this donÔÇÖt have a exemption, the company paying needs to withhold tax of 25% – via a tax form which I canÔÇÖt recall the name of. The legislation has changed drastically over the years so best to check with your accountant about whether this is accurate. Some firms like to act on the side of caution.
Very frustrating I know!
I work in IT contracting and my agency withholds 20% by default and pay it to IRD like PAYE
I think you can apply for a different rate using an IR 330C
Very specifically, is your “client” the end client or do you have a middleman like a recruitment agency, or service provider that is subcontracting to you?
In 2017 the rules for Withholding changed so that “Labour for hire” agreements were required to pay withholding tax. More info here : https://www.taxpolicy.ird.govt.nz/publications/2016/2016-commentary-bteirm/other-business-tax/extending-withholding-labour-hire-firm-contractors
I would say that, depending on what you do with your tax anyway (Do you pay it as you go, do you try and get your $5 in interest in a savings account before paying it), it may not make any difference at all since the withholding tax taken simply adds to your end of year tax take anyway.
They are just trying to protect themselves – not doing anything shady. Get the exemption youÔÇÖll be sweet
You need a withholding tax special tax rate certificate showing zero % from IRD.
You can request it online.
I thought maybe it was cheaper to actually do withholding tax no? If it all goes through my HNRY they take a cut of that too but if 15% is withheld then HNRY wonÔÇÖt take a cut of that?
