Title: AI Legalese Decoder: Facilitating Resolution of Complex Fence Line Disputes

Introduction

In search of a swift and cost-effective solution to an apparent disagreement regarding a seemingly uncomplicated fence line issue, the AI Legalese Decoder proves its utility. This advanced technology helps bridge communication gaps and legal complexities, enabling a smoother resolution process.

Background: Complexity Surrounding the Fence Line Issue

Decades ago, a previous property owner and the former neighbor constructed an embankment using large boulders along the property boundary. However, when intending to sell the property three years ago, the prior owner erected a high-quality hardwood fence approximately 1 meter inside their property, due to the challenging layout of the boulders. To avoid potential disputes, experienced neighbors advised conducting a survey to mark the correct boundary.

Recent Developments and Language Barriers

Since the previous neighbor passed away, a new owner purchased the property without being informed about the boundary matter. Unaware of the implications, they began cleaning up the land and constructing a fence along their frontage. The current issue arises from their limited English proficiency and lack of understanding regarding boundary matters. Despite repeated attempts to communicate, the neighbor persists in claiming that the fence’s current location is satisfactory, exhibiting the Dunning Kruger effect.

Clear Legal Obligations and Proposed Solution

Thorough research conducted by thoroughly examining the Gold Coast council regulations and the latest title deed has established a clear course of action. Both parties are obligated to share the cost of a survey to mark the correct boundary accurately. Consequently, options such as relocating or constructing a new fence, though potentially redundant, have emerged.

Assuming the rock pile is part of both of your properties and the fence would be somewhere in the middle of it, just pay for a survey yourself and have the marker pegs put in to indicate the boundary.

If that doesn’t suffice, Put in two posts in the middle of the rock pile and run a string line indicating the boundary.

You should consider moving the fence. Would be interested to see photos.

    This might help: https://www.qld.gov.au/law/housing-and-neighbours/disputes-about-fences-trees-and-buildings/avoiding-fence-tree-and-building-disputes/your-responsibility-as-a-fence-owner

If the fence is built on your land it appears you own the fence.

    >If it is built on the common boundary line, a dividing fence is owned equally by the adjoining neighbours. However, a fence, or part of a fence, built on one neighbourÔÇÖs land is owned by that neighbour, even if the other neighbour helped pay for the fence. You should be careful to build your fence on the boundary if you are paying half the cost.

Mediation would be the next step. They’d be contacted and come along. If language barrier is an issue that can be sorted too – there are translation services available.

You can go to QCAT – that link has plenty of information.

A neighbor of mine had a fence in the wrong spot for 80 years, but when the new neighbors found out – the land did not cede to the other party – the fence had to be moved or the land paid for
