    Yes, you could have him sign some sort of promissory note for what he owes you. Doing so isn’t necessary to enforce your claim (you could evict him and seek a money judgment for rent now) but it probably helps.

    Suing him doesn’t create money for him to pay. Obviously you believe he’s made bad prioritization decisions with his money. Your judgment doesn’t unwind those, or even force him to make different decisions tomorrow. It just gives you tools to collect what is owed.

    You have a decision to make. There are three reasonable choices:

    1. You can start the eviction process now with a notice to cure as may be required in your state.

    2. You can have him voluntarily surrender the property and sign a promissory note. Suing on that prom note is probably cleaner and easier than eviction, so if he’s agreeable and you’re committed to him leaving that’s probably an ideal path.

    3. You can have him sign some sort of agreement that preserves his tenancy, rolls his past due rent into some specific agreement for repayment, and accounts for his tenancy going forward. The advantage to this is that keeping him with somewhere to live probably preserves is financial ability to pay you. Perhaps the agreement is something like “rent is $500 and you agree to pay $1,000 per month until your $3,500 past due is caught up.”
