## Concerns Regarding Property Oversight

Hi folks,

So, here’s an interesting one….we moved out of a property after ending a fixed term lease early, technically its still ours till end of 2024 but a new tenant has been found, So we now have it till Mid April.

To be sure the place is safe, I’ve put a camera there to see the comings and going and today we noticed the owner of the property in the house without our permission.

What are the legal ramifications of this? If any….

Very little. Potentially a civil tort but that’s going to be minimal.

    None.

I suppose the flip side is that your lease almost certainly requires you to not leave the property unoccupied for a certain period of time (in my case it’s 30 days). So even if you did have a theoretical cause of action against the landlord, they would also have a theoretical cause of action against you by the time your lease term expires.

Sounds like it would be a lot of hassle for basically nothing at the end of the day.

From personal experience renting, I’d argue it’s a breach of convenant to quiet enjoyment and, likely, of contract.

You could contact them, restate your right to quiet enjoyment and that permission to enter must be sought at least xx hours prior (as per tenancy agreement).

Other than that, there’s not really much else at this stage. If it’s repeated entry without permission, you might claim harassment.

As you’re not there any longer, this all may be somewhat of a stretch.

If, however, you’ve given up the keys (doesn’t sound like it given the CCTV), it can muddy the waters.

State that it is a breach of contract, after checking the contract.

It is unlikely to lead to much more than this.
