    You can try, but you’d likely lose. You didn’t pick up your stuff when you had the chance, that’s on you. Plus all those things that are gone are easily replaceable at low/no cost.

    The lender and the tow yard most likely share this feeling: ‘If someone can’t afford to make their car payments, then they probably can’t afford an attorney.’

    I’d be guessing here – but when it comes to sensitive personal identification, I would almost bet they have a policy that says they HAVE to throw that stuff away to avoid any liability. If you come back to pick up your stuff, and everything is there except some credit cards or cash, then you’re immediately going to blame them for stealing. Easy solution, just throw everything away and avoid any liability. (Tow Yards, Scarp Yards, Tire Yards – all notorious for being easy money laundering fronts. It also wouldn’t surprise me if they have a ‘throw-away’ policy, but actually keep some items of value and sell/pawn them under the table)

    Personally, I’m okay with the consequences of certain actions being inconveniences like this. Does it suck to have to go through all those steps to get your stuff back, of course, no one enjoys the BMV or dealing with the Social Security office. I’m okay with it, because after doing those annoying, time consuming tasks, my hope would be that no-one would want to put themselves in a position where they would have to go through that again. If someone not making payments only affected them directly, that would be one thing. Unfortunately, the people who are defaulting on loan payments, are responsible to everyone else when prices go up at the banks; When someone misses multiple payments and the bank has to act by hiring a repo agent to confiscate the vehicle, have it towed, etc. The bank isn’t be okay with losing that money and they aren’t going to just go back to business as usual. They have investors to answer to, they’ve made projections, and now other ‘customers’ are going to make that difference up. How? They raise prices, increase interest rates, add fees places they didn’t used to be – all directly affecting other consumers who might be needing loans, making them more expensive to pay back, and decreasing both eligibility and buying power of some buyers.
