## Situation with Former Boss and Legal Questions

Last week, I found out that my boss was unable to make payroll at the company where I worked as the main office worker and handled most logistics. Realizing the situation, I informed my boss that I was resigning from my position. I made sure to hand over all necessary paperwork, passwords, and schedules for the field workers before cutting off contact by blocking his phone number.

Despite my attempt to leave the company in an organized manner, my boss decided to escalate the situation by instigating a conflict with a field worker who was also a close acquaintance of mine. This led to the field worker resigning as well, ultimately resulting in the closure of the business. It’s important to note that I was in an “at will” employment state and not obligated to provide notice before resigning.

The issues with my boss began because he frequently failed to show up for work, communicate, or fulfill payment commitments, leading to him owing me for 19 weeks of unpaid work dating back to the beginning of 2023. Since the incident, I have received multiple threatening voicemails and emails from him, including threats of physical harm and potential defamation within the industry.

Considering the ongoing harassment, I am exploring if there are any legal options available to address the situation.

I wonder if that could be argued as defamation if he does so.

Or blackmail if he mentioned how you’d better get back to work.

I would think you have more than enough evidence to pursue legal action if this dude decided to be that big of an asshole.

If you’re owed 19 weeks of pay you need to contact your states wage and hour division

Yes it literally says do not use the registry for harassment purposes. We are still civilians afforded most of the rights against such behavior. But, if he just sends out what is already stated on the registry it’s a gray area as it’s information readily available online. The threats of violence is a crime and can be pursued though.

You have to file police reports.

I say this for many reasons…

    1. What he’s doing is illegal and not something you shouldn’t have to deal with or tolerate.

    2. Your personal safety is at risk.

    3. The more that police and government officials (and other humans in general) see what being on the registry does to people the more change can be made.

So, do it for you, do it for the next guy he would do this to, and do it for all people on the registry.

You do not deserve to be treated this way.

And, I’m sorry, I’m sorry you’re having to deal with this. It’s horrible.

If you do not have the finances to hire an attorney, you may want to look into filing a Charge of Discrimination with the Equal Employment Opportunity Commission. http://www.eeoc.gov

If he said you don’t come back to work or he will out you that is blackmail or extortion. Depending on what state you’re in. Which is a felony. Since it’s a company you could even sue the company. You can also sue them for the backed wages. I would report it to the labor department immediately. Also get a lawyer and show those threatening messages. Also, get a restraining order. A restraining order could prevent him from posting anything on social media about you. Even if it is public information.

Most states make it illegal to use the registry information to harass someone. That being said i’ve never seen it prosecuted, If he did retaliate against you like that, this might be a good case of it though.

The problem is you went 19 weeks unpaid. You have to value yourself. It you did the work and didn’t get paid it’s time to move on. Fool me once shame on you. Fool me 19 times shame on me.
