Current Situation as Lasting Power of Attorney

Hi, I am currently acting as the lasting power of attorney for my Dad, who is in a care home. After my Mum passed away last year, none of my siblings were willing to take in her elderly cat. I ended up taking the cat in, but I made it clear that I couldn’t afford to cover the expenses for her, such as food, cat litter, and healthcare, as I already have my own pets to care for and support. Therefore, taking care of their cat was more of a fostering situation for me.

Additionally, there is another lasting power of attorney appointed to my brother, with whom I am no longer in contact due to his struggle with schizophrenia and his tendency to blame me for various delusions he is paranoid about.

As the cat is in need of veterinary care that I cannot financially bear, and there have been negative comments made by the other lasting power of attorney regarding my use of my Dad’s funds for the cat’s expenses. I am concerned about using my Dad’s money for the cat’s medical needs, as I fear that the other lasting power of attorney will create conflict over this issue.     The fundamental principle with an LPA is that all decisions must be made in your dad’s best interests at the centre of everything. 

    It is not in your dad’s best interests for the cat to suffer. Is your brother motivated by ensuring he inherits every possible penny? That’s not in your dad’s best interests either…

    What would your dad do if still had capacity? I presume he’d get treatment for the cat. 

    As the cat’s keeper (but not owner) you can’t just allow the situation to drag on with the cat going without veterinary care – you have obligations under the Animal Welfare Act 2005.

    I would suggest that your brother isn’t currently capable of acting in your father’s best interests. It would be worth having a chat to the OPG about your concerns over your brother’s actions.
