Grandfather’s brother can file a claim against grandfather’s estate for upkeep that wasn’t done as a condition of the life estate.

Accounts that you are a joint owner or where you are listed as a beneficiary are generally not part of the estate, but states laws may vary. I would contact an attorney if you receive a notice that a lawsuit has been filed.

Don’t give your great uncle any money based on his threats.  If you’re served with paperwork for a lawsuit, hire an attorney to represent you.

If your post is correct, you were a co-owner of the bank account and a direct beneficiary of the IRA and annuity.  If that’s the case, your uncle would have difficulty making a case against you for accepting those funds.

He may be able to sue your Grandfather’s Estate, contest your Grandfather’s will, or file to contest the beneficiary designations on those accounts.

But don’t let him manipulate you into handing over any money unless it’s court ordered.

Sounds like a pretty hollow threat.

In my state, and I believe some others, a creditor of the estate can, in some circumstances, recover from funds that pass through a bank account’s beneficiary designation. In other words, if decedent dies owing someone money, and there are not enough funds in the estate to pay the debt, then in some circumstances the creditor might be able to make a beneficiary of a bank account return some of the money so that the estate debt can be paid.

Based on the very limited information in your post, that is the only type of potential claim I can think of. That said, I have no idea of your grandfather’s brother has any valid claim against your grandfather’s estate.

No, he has no standing and will lose. Let him sue.

I can sue you for posting this. You should treat him like you will treat me going forward: Ignoring me and saying zero. If you receive legal documents in the mail or in person, respond to those documents.
