    At the end of the day, you don’t have to voluntarily pay the charges in excess of your security deposit. If you don’t, she’ll have to sue you for them and the court will require more than her word alone.

    If it was me, I would tell landlord to go pound sand. And sue said landlord for your $8500 deposit asap. That way you compel her to document the damages in court. She will likely countersue. Then you hire a lawyer and add your legal fees to the claim amount in your lawsuit.

    I am lawyer but not your lawyer. This is a pretty easy issue to handle on your own, without an issue, in small claims court. If she does not return your security deposit within 21 days of moving out or provide you with an itemized list of deductions with receipts/invoices substantiating the deductions. If she fails to do so, you are entitled to 2x your security deposit. Make sure she has your forwarding addresses and have written proof of the day you handed over the keys and vacated. After 21 days, write a letter m ( I prefer email if you regularly communicate via email) to her asking her to return your security deposit and cite the California code section that requires it. If she doesnÔÇÖt respond or says no, write her again and let her know if she fails to remit the security deposit youÔÇÖll be filing in small claims court for $17,000 pursuant to that code section.

    When I was fresh out of law school my apartment failed to send my security deposit back within the 60 days our state required. They were scrambling at day 65 to try to send it to me and I said nope to late under our states law you owe me 2X. TheyÔÇÖre lawyer called me and tried to make me feel back but they were a shit management company and I said no I donÔÇÖt feel bad they held onto my money for over two months- and he agreed to send me the 2x the security deposit. It was easy money.
