    In my view, 7 days is not reasonable notice – frankly for that sort of length of occupation, notice on the order of months at the very least, I think is more acceptable.

    I note that the Earl of Macclesfield, being evicted from his ancestral home which he had been occupying for 10 years, was given 2 years notice to leave in [Parker v Parker [2003] EWHC 1846 (Ch)](https://www.bailii.org/ew/cases/EWHC/Ch/2003/1846.html) by Lewison J as he then was.

    Your problem though, is that your uncle will do this, and I am almost certain the police will fob it off as a civil matter – indeed only a court can really decide what is reasonable. Tactically you need to stay put – if violence is about to occur call 999.

    What you need to do is see a solicitor tomorrow and make an urgent application for 1) interim relief: an injunction that you are not to be evicted and 2) a claim for declaratory relief: what is in fact the reasonable notice that must be given for eviction.

    Of course if you are actually evicted when youÔÇÖre suing for breach of the reasonable notice term in the licence you had to occupy then youÔÇÖre probably only going to get damages if youÔÇÖre living elsewhere.

    Time is of the essence to see a solicitor though.

    Even if he can lawfully evict you soon (which is debatable) your uncle absolutely cannot throw your property away! They must give you reasonable opportunity to collect it, and considering you’ve been living there for a long time (and probably have large furniture etc), one week isn’t reasonable. Document what is yours – if he does throw stuff away you can sue him for its value.

    On the other hand you have already been a victim of criminal behaviour by your uncle (throwing away your property) and have good reason to expect more. You may want to comply to ensure your own safety and minimise risk of loss; a storage unit and a moving firm will make sure you don’t lose what’s yours and is probably cheaper than lawyer’s fees.

    You are not a squatter, this is your home. You need to be served a section 21 first, giving you 2 months notice. If this is ignored, your uncle then needs to apply to the courts for a warrent of possession. This date can also be ignored, then finally he’ll apply to he courts again for notice/warrent of eviction. This could take up to 6 months total time. I know, I’m kicking out my tenants right now and it’s bloody expensive and a pain in the arse. The law is on your side, not your uncles.

    Does your uncle own the property outright now or was any part owned by your grandma?

    Who gave you permission to stay in the property without paying rent?

    At any rate, if you do not own this property or have a contractual right to be there you will need to move out. I’m guessing your uncle owns the property outright and was allowing his mother to stay there making your grandma the effective tenant from a legal perspective and by extension I’m guessing that your grandma allowed you to stay making you in legal terms a “Permitted Occupier”.

    In this case when the tenant stops being the tenant, the permission for you to occupy ceased immediately. The landlord needs to make a possession order to you which they have done. They have the right to ask you to leave within 24hrs but have given you 7 days. After that possession order stops you are illegally occupying the property at which point you will be classed as squatters. The landlord can make an emergency application to the court for an interim possession order and you can then be forcibly removed by bailiffs or the police.

    In real terms the landlord can in no way directly force you to leave and if they do you can call the police to prevent that. But the police will otherwise not get involved because it is a civil matter.

    You have to start looking for alternative accommodation now or ask you uncle to negotiate a longer time to find a place or maybe even offer to be tenants and actually pay rent which will give you so much more rights in this situation.

    Very stressful and sad, I am sorry to hear about your situation. Most importantly, did you and your sister ever help with home maintenance in any way or home improvements? This can include gardening, painting, repairs. It sounds to me like you may well have a claim to a % of the property (on constructive trust) – I recommend getting proper legal advice from a chancery or land lawyer asap! You may be able to get a temporary injunction against your uncle to keep away from the house for a month or so if heÔÇÖs showing repeated threatening & harassing behaviour towards you. Even if you donÔÇÖt have a right to the property, there is absolutely no way your uncle is allowed to remove your belongings. If he does that, he will be in breach of the law and you could sue him. Please do get advice from a solicitor – there are some free helplines like Shelter and Citizens Advice that might be able to help if you canÔÇÖt afford someone private. Good luck!
