    Unfortunately this is very normal these days, you need to go back to your contract and see what it says. I really do feel your pain though, I signed contracts in Nov 21, build commenced Apr 22, and I finally got the keys Jun 23.

    I’m in QLD but presumably it’s similar. The building contract should note a start date and a contract period with allowances noted for weather and stuff. Then there will be a “late completion damages” figure. For the contracts I do it’s $50/day unless the client negotiates a higher figure at the start.

    That sounds like a great sales pitch ÔÇ£build in under a yearÔÇØ, which is an absolutely lie and is a common sales pitch to get you to buy and can easily be extended unfortunately.

    Lucky for them itÔÇÖs not 3 years which is currently whatÔÇÖs happening. What does the contract say? Does it have an extension of time clause? If so, were they given an extension of time letter? If yes, theyÔÇÖll likely have to reject the claim within 5 days of the letter being sent or the number of days they claim automatically get added on.
    If not, and it truly has gone over the contracted days (not including business days or before council approval and other relevant document approval etc. Although itÔÇÖs rare that the builder would not have their back covered with an extension claim) then youÔÇÖll be able to go to the relevant building commission to complain. Although it is a lengthy procedure and the commission is already bombarded with claims.

    Builders wonÔÇÖt say much over email and will rarely answer as 1. Nothing has progressed in the build and therefore theirs nothing they can say, 2. emails can be used as evidence later on down the track. The less they say the better when it comes to suing. 3. TheyÔÇÖre absolutely bombarded by emails and calls on the daily and canÔÇÖt get back to everyone.

    Unfortunately, without looking at the contract itÔÇÖs pretty hard to give a correct answer. Hope this helps

    Generally the building contract has a provision for the builder paying you a certain sum for every week past the contracted end date (for my two builds it was $500/week), usually it is a lot less than that though

    Built house in 2017 in QLD and builder ghosted me too. It wasnÔÇÖt until a month before the scheduled finish date they told me it wouldnÔÇÖt be done, and they couldnÔÇÖt give me an updated date or even a window. I called them everyday for 2 weeks, annoying them as much as possible (and I had the general managers direct mobile, so I could be really annoying). They eventually relented and finished 2 months late. This did cost me the inspection, but for me, it was either be homeless or be in a potentially non compliant house. I chose the house.

    Contact fair trading or relevant authority in your state. They will follow up with the Builder. Notwithstanding if the builder hasn’t left the site they cant do much. Issue a notice of delay per your contact request for the works to be expedited. Maintain a good record and ensure you apply Delay Damages per contract.

    The builder must communicate, and inform you of any potential delays.

    Builder cant claim EoT on concurrent delays. If it goes legal the Builder has to substantiate the delays since they are claiming for it.

    I have done EoT assessment and its a lengthy process. Avoid lawyers for now. As long as you can show the Builder you are confident in Contractual matters they will get their act together.
