Title: Seeking Assistance for Neglected Parental Responsibilities: AI Legalese Decoder to the Rescue

Introduction:
In the state of Michigan, after my divorce in 2013, my ex-husband and I shared 50-50 custody of our two children – an 11-year-old son and a 9-year-old daughter. Co-parenting was initially amicable. However, over the years, the situation has deteriorated considerably. My ex-husband’s negligence towards his parental duties has led to an absence of contact with our children for the past six years. This unfortunate situation has negatively impacted our children’s lives, leaving me in dire need of legal assistance.

Background:
Following our divorce, my ex-husband’s commitment to our children gradually diminished when he started dating his current wife in 2016. His parenting responsibilities were neglected as he prioritized spending time with his new partner, leaving our children in the care of his parents. This prompted me to invoke the right of first refusal, resulting in a court hearing that shifted custody to me as the primary caregiver. His visitation rights were reduced to every other weekend.

Complications:
In 2017, my ex-husband remarried and decided to re-enlist in the military. Unfortunately, this decision further complicated matters as he cut off contact with me and our children. To serve him with child support papers, I had to resort to tracking him down through military channels. After a rigorous battle over child support payments, we agreed on a settlement of $900, which barely covers the financial needs of our children. I currently have full physical custody, joint legal custody, and he only gets visitation rights during holidays and summer break, provided he arranges transportation.

Current Situation:
Despite being entitled to visitation, my ex-husband has not seen our children since he left for military boot camp. Both our 11-year-old son and I are blocked from contacting him. He has not made any effort to call or communicate with the children since February or March. Moreover, he is estranged from his entire family, who are all supportive of me and our children. His wife has successfully alienated him from us and even her own child’s biological father. This neglect extends to their own two children, leaving our kids feeling abandoned and hopeless.

Desperation and Seeking Solutions:
In July, my ex-husband briefly communicated, acknowledging that his wife was responsible for blocking contact and deleting my number. However, since then, all communication has ceased. Even during a visit to his wife’s family, he did not make any plans to see our children, despite my efforts to reach out. Our daughter’s recent birthday went unnoticed, with no phone call, presents, or cards. As a single parent, I find myself trapped in a distressing situation. Legal representation is prohibitively expensive due to high retainers, further exacerbating my feelings of helplessness.

Under these circumstances, I am in desperate need of assistance. Fortunately, with the advent of modern technology, tools like the AI Legalese Decoder can provide practical guidance. With the debilitating financial burden and emotional strain that accompanies such a situation, the assistance provided by the AI Legalese Decoder will be invaluable in helping me understand my rights, assess the feasibility of pursuing additional child support, and explore options for modifying his visitation rights. You can ask for child support modification, but be sure you are going to get a bump up and not downward. The latter often happens against people’s expectations based on present income available for support, and is always extremely disheartening.

As for custody, given it has been years and father is not involved, moving the Court for sole legal custody may be successful. You have good reason to want it – i.e. to make decisions about school and health care for the children.

The problem could be here if dad gets aggressive in responding to any motion you bring. Custody things are so very sensitive, and people can really get bent out of shape and go on the war path. Doing any of this without a lawyer is a recipe for disaster.

Your ex is using his new wife as an excuse on not contacting his children. You said it yourself he blocked his own family because they are apart of your kids lives. If he couldnÔÇÖt contact yÔÇÖall. He could have easily contacted them to get you information.point blank he just doesnÔÇÖt want to be a parent but he also doesnÔÇÖt want to admit fault. If he wanted to be a father to yÔÇÖallÔÇÖs children he would have. You should also contact a lawyer because even if he did see the kids. They should still be cover under his tircare ( insurance provided my the military) you also need to make sure yÔÇÖallÔÇÖs kids have his information because when her retires from the military Rado due to reaching full retirement, or due to disability. Your kids will be able to get whatever percentage his VA benefits are to help cover a portion of their college. By not having a loyal and making sure that your kids or not taken care of under his VA/military benefits, you are sorting the children in the long run.

I think it might be worth going back to court to have full legal custody.

You donÔÇÖt want to get into a situation where something happens with one of the kids and he can just show up out of the blue and demand to exercise his rights. What happens if, god forbid, one of the kids has a serious medical condition or issue and he swoops in and tries to demand a different treatment? Or thereÔÇÖs an issue with the school?

As long as youÔÇÖre willing to take the risk that child support might not go up as much as youÔÇÖd hope, or even go down, I think itÔÇÖs worth going back to court and asking the court to order CS per the court guidelines, and ask for full legal and physical custody with only supervised visitation that he pays transportation for.

If you go down this path, make sure to make your lawyer aware of the emails his new wife has sent, along with the failure to contact the kids on their birthdays etc.

  • MostAssumption9122

Also they could be allowed to get a family member ID card too

  • BORGQUEEN177

His pay has gone up. He has been promoted and has gotten pay raises. He should also be covering their health care and they (you via them) have access to military resources. ItÔÇÖs totally worth it to go back to court.

  • uvaspina1

Unless you suspect his earnings have drastically increased I donÔÇÖt know what benefit you could realistically expect from taking him to court. You already have full physical custody and the joint legal custody is basically a fiction since he doesnÔÇÖt exercise any of his rights. If I were you IÔÇÖd just ride this out and take the $900/month and forget about him.

  • Silent_University_86

Friend of the Court is your answer here. First children do come first.

  • dumb_old_girl

Are your kids enrolled in DEERS? Are they receiving their healthcare thru the military?

  • captainquacky

ianal but I thought the military was very much against a lot of that behavior, at least the way my friends wife explains it. wouldn’t reporting it too his c/o or command help with getting the child support? I’m sorry if the information I have isn’t correct.

  • milkfilledb00b

YouÔÇÖre already getting his money. He wants nothing to do with you or the kids. Just leave it alone

  • heathercs34

Get in touch with his commanding officer and let him/her know that heÔÇÖs in arrears in child support. They usually donÔÇÖt mess around with that stuff. TheyÔÇÖll garnish his wages.

  • GoddessOfOddness

Most states have their child support calculator online, so you can figure it out ahead of time to see if itÔÇÖs worth it.

What is it you want the Courts to do? They canÔÇÖt force him to be a good dad. All they can do is enforce the child support order.

Also, his being in the military complicates things. He has certain federal protections regarding custody and parenting time orders. ItÔÇÖs very situation specific. So if you want to do something about his parenting time, (though I canÔÇÖt imagine what), you will want an attorney who has handled military custody issues before.

  • Thumperdebunny

Ask his family where he is stationed. And what unit he is with then make a call to CO 1st Sgt. And see how they respond to you. This will tell you if you have someone you can or canÔÇÖt. Work with in your favor. That would be my first step. Then you can decide what is your best step moving forward. If they are in full support of you. Then you have a very good chance of getting atleast. Tricare and deers. As well as chapter 35 benefits for college and such. Just my opinion
