    Anyone well trained knows that a line is negative. They donÔÇÖt get to give an opinion because they think the line is too light. I I would immediately report this to the facility as well as the state agency that regulates them. This is nonsense and they are playing with peopleÔÇÖs lives here.

OP I deal with 12-panels all day for my job (work with state inmates) and a line, even if itÔÇÖs faint, **is a negative result.** Clearly a lot of people in this thread have no experience with these. This is urinary drug screens 101, one of the first things weÔÇÖre taught when interpreting these results. I have no idea what the lab tech was on.

    I donÔÇÖt really have any advice, but perhaps emailing HR explaining what happened, with something along the lines of ÔÇ£When the lab test comes back negative, will I be paid the lost wages for these two weeks?ÔÇØ Or something to that effect may send a message.

    No one is giving you a straight answer. There is currently a good deal of new case across the US that finds that testing companies can be held liable for false positives that result in material harm. It would not hurt to talk to a lawyer

    If the tech negligently interpreted the test wrong, then maybe you would have a claim to damages. Consult an attorney to learn the actual strength of such a claim.

    I worked with these as well. Tests are done in two stages. The first is the collection and “litmus” result. An agent is present that reacts with metabolites from a drug. I had a lot of ADD and ADHD guys. When our policy was to act on the results of the first test, they loved it. Most of them used Adderall, which tests positive for amphetamines (like meth). They got put on leave, thus a free holiday.

    The second test is when the sample goes to the lab and the substance is identified by mass spectrometry (MS). The second test also includes a pharmacist or doctor who rules out legally prescribed drugs that test positive, like my Adderall guys. This is when they went back to work.

    Get your company’s policy from HR and read up on the procedures you guys use. If they test that often they will have robust procedures. Generally you are paid until the completion of the second test. The MS is very accurate.

    The only person you should be talking to is either your direct boss, HR or someone assigned to you. Personnel policy will lay that all out including what steps you need to take.

    Reddit loves the “get a lawyer” but find out what your company’s procedures are before you go too far down that path.

    But this loss in time poses a question What about unemployment? Loss of hours is a valid reason (atleast from memory NAL), so this down time could recoup something and then if its negligence the employer can go after the testing center for damages? Or am I waaay out in left field?

    A legitimate lab testing needs to be confirmed with gas chromatography. After the quick screen.

    The quick screen to filter out which ones donÔÇÖt need the more expensive test that is very accurate. They issue a lab report.

    I would ask to them for a copy of the lab report

    A faint line is still a line in a drug test. It’s not perfect and there are protocols in place to identify a false positive. The collection agent is just doing their job. It’s not their fault there were two lines. As long as your job is following the same policy for you as they do for everyone else then they are not doing anything illegal.
