Quick question: did the company take any adverse action against your wife for her pregnancy or maternity leave? Or does she only have the evidence of someone else being discriminated against? IÔÇÖm a lawyer and did a brief stint in employment law, so I only ask because she might not have the standing to bring an action against them for discrimination if she hasnÔÇÖt suffered any damages. IÔÇÖm not expert in this area and this isnÔÇÖt legal advice. You should consult an employment attorney in your area.

Not a lawyer, but am a liaison between the staff and central administration (including HR) and deal with many of the complaints filed at my org.

If all they did was bash her in a group thread, there is likely nothing you can do. While it is certainly unprofessional, being unprofessional isn’t illegal.

On the other hand, bringing this up would likely be problematic for your wife, as nearly any job under the sun has terms for authorized use of computers and data, and I’m certain there would be something in there that going on someone else’s computer to open up their messages would be unauthorized use, which would be grounds for a valid termination. If they do want to get rid of her for taking maternity leave, this would be 100% legal grounds for them to do so.

She can certainly leave if she feels so inclined. But unless you have rock solid evidence of discrimination in the form of lost promotions, opportunities, a firing or demotion, directly related to pregnancy; there isn’t much to be done. People can have terrible attitudes without having done anything illegal

Unless they actually took an adverse action, nothing. Unfortunately being an asshole isn’t illegal

It doesnÔÇÖt seem like there is anything to do right now. Talking badly about an employee privately isnÔÇÖt illegal. But she should definitely consider what she wants to do regarding her job going forward and do what makes most sense for her.

Get an employment attorney immediately. Document everything that happens from here on out. Should your wife be terminated, they will settle as it would be well within their best interest.

I would consult an employment lawyer and see where she stands from that perspective.
