AI Legalese Decoder: A Solution for Landlord-Tenant Disputes

As a tenant dealing with a landlord who is not taking proper action to address a bedbug infestation, it can be incredibly frustrating and stressful. In this situation, one option could be to take matters into your own hands by paying for a heat treatment and deducting the cost from your rent. However, this course of action could potentially lead to conflict with your landlord, who may decide to report you to the credit bureau. This raises concerns about the potential consequences of such a report and whether there would be an investigation into the credibility of the landlord’s claim.

You can not withhold rent without an order from the LTB, pay your fill rent or you may be fighting an eviction.

You can’t with hold rent without an order from the LTB, so I’d be worried about him starting the eviction process as well. Have you submitted the proper forms for this issue to be dealt with?

  • derspiny

I’d be less worried about the credit report and more worried about the fact that your landlord can evict you if you do this. Maintenance issues are not on the province’s very short list of reasons you can withhold rent.

If you want to deduct costs for repairs your landlord is refusing to do, you need to file a T6 application with the Landlord & Tenant Board and get an order authorizing it first.

    > When you get reported is there an investigation into whether or not the claims are credible?

No. However, you can dispute inaccurate entries on your credit history yourself at any time.

A report that you did not pay your rent when you did not, in fact, pay your rent is not inaccurate.

You cannot withhold rent for this, you are required to pay your rent. You need to use the proper forms to get a rent reduction or compensation: https://tribunalsontario.ca/ltb/forms/

You’d also be able to dispute any debt sent to collections as the landlord requires an order from the LTB for it to be valid. As another poster said, they could start eviction proceedings if you don’t pay your rent, though paying it will usually resolve this.

Landlords generally don’t report to the credit bureaus.

Thank you to everyone for the advice. IÔÇÖm just feeling stuck and not sure what to do. I want to get rid of the bedbugs before it gets worse and spreads around the building.

IÔÇÖll start by filing a T6 and possibly calling a bylaw officer to inspect.

It wonÔÇÖt go in your favour if you withhold rent. Do not do it under any circumstances.

  • cernegiant

Your plan is a very bad one. You can’t withhold rent like that whiteout an order from the LTB. You can be evicted and have your credit ruined.

File a complaint with the LTB and your local property standards people.
